P- 97-36 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA APPROVING TENTATIVE PARCEL MAP 97-03 ASSESSOR'S PARCEL NUMBER 323-262-01 WHEREAS, Tentative Parcel Map 97-03, submitted by Lori Cota proposes to divide a .97 acre property into two parcels, one and one residential each approximately one-half acre in size. The property is located at the southwest corner of Poway Road and Sudan Road, in the Automotive General C and Residential Single-Family 2 zone; and WHEREAS, on August 5, 1997, the City Council held a public hearing on the above- referenced item and heard testimony both pro and con. NOW, THEREFORE, the City Council does hereby follows: The City Council hereby issues a Negative D lh Mitigation in the area of Hydrology. The approved project' : with the General Plan in that it proposes to separate a parcel which is presently designated for two land uses, and residential into two buildable lots. The design and improvements required of the tentative parcel map are consistent with all applicable general and specific plans; in that the approved parcel sizes and confi§ :lhere to the City's development standards. The site is physically suitable for the type of development and the density proposed. There are no native plant present on or using the property. The tentative parcel map is not likely t in that City water and public health problems to the buildable parcel. The City Council hereby approves Tentative Parcel Map 97-03 subject to the following conditions: Within 30 days of approval, the applicant shall submit in writing that all conditions of approval have been read and understood. COMPLIANCE WITH THE FOLLOWING CONDITIONS IS REQUIRED. The applicant shall obtain an easement which permits ingress, egress, use and i Sudan Road as the legal access to Parcel B prior to approval of the parcel map and its recordation. _ Resolution No. P-97-36 Page 3 COMPLIANCE WITH THE FOLLOWING CONDITIONS IS REQUIRED. COMPLIANCE SHALL BE APPROVED BY THE DEPARTMENT OF ENGINEERING SERVICES. GRADING Grading of the subject property shall be in accordance with the Uniform Building Code, City Grading Ordinance, approved grading plan and geotechnical report, and accepted grading practices. The grading plan shall 'tificate signed by a registered civil engineer that the grading plan has preserved a minimum of 100 square feet of for each dwelling unit and for each future building site within the subdivision. A soils report shall be prepared by a qualified engineer licensed by the State of C :1 submitted to the City at first submittal of grading plans. The final grading plan, prepared on a standard sheet of mylar, shall be subject to review and approval by the Planning and Engineering Services Departments and shall be completed prior to start of grading operation. A pro-blast survey of the surrounding property shall be conducted to the satisfaction of the City Engineer prior to any rock blasting, A blasting permit shall be obtained from the Engineering Services Department prior to any rock blasting. Seismic Recordings shall be taken for all blasting and blasting shall occur only at locations and levels approved by the City Engineer. 6. All new slopes shall :2:1 (horizontal to vertical). A final compaction report shall be submitted and approved prior to issuance of building permits. A certification of line and grade, prepared by the project civil engineer, shall be submitted prior I f building permits. Buildings and parking lots shall be at least five feet from tops and toes of slopes, unless waived by Planning and/or Engineering Services Departments prior to grading permit issuance. 10. Non-supervised or non-engineered fill is specifically not allowed. Rock disposal areas shall be graded in compliance with City-approved soils investigations and :lations and grading plans. 11. 12. The developer shall make provisions to insure th,e prop of all erosion control devices throughout their intended life. The property has no recorded access rights to Sudan Lane as disclosed in the Preliminary Title Report (No. 7861094-N81 ) prepared for this project dated March 20, 1997 by Stewart Title of San Diego. In order for the 2 parcels proposed to have access to Sudan Lane, a private road easement must be acquired by the property owner and a recorded copy of said easement shall be provided to the City's Engineering Services Department prior to parcel map approval. A road maintenance agreement for Sudan Lane along the property's eastedy boundary shall be executed and recorded in the office of the San Diego County Recorder prior to map approval. Said agreement shall be in a form acceptable to the City Attorney. Intersection drains shall be required at locations specified by the Director of Engineering Services Department and in accordance with standard engineering practices. A drainage system capable of handling and disposing all surface water originating within the project, and all surface waters that may flow onto the project from adjacent lands, shall be required. Said drainage system shall include any ~ required by the Director of Engineering Services to propedy handle the drainage. Concentrated driveways and/or sidewalks shall not be permitted. The ponding which occurs on the new Parcel B shall be mitigated by installation of area drains which will collect water and divert it within the appropriate structure to connect with the improved concrete drainage structure located along the westedy boundary of the adjacent lot to the west, Assessor Parcel Number 323-262-02. This improvement shall be installed at the time of of the proposed single family home on Parcel B. Resolution No. P- 97-36 Page 5 SEWER & WATER Water and sewer systems shall be designed and J to meet the requirements of the City of Poway and San Diego County Department of Health. Fire hydrants shall be installed at locations, to be determined by the City Fire Marshal. Within 30 days aft ' ' 3 City Council approval of the project, the applicant shall apply for a Letter of Availability (LOA) 1 ;le availability and post with the City, a non-refundable fee equal to 20% of the sewer fee in effect at the time the LOA is issued. Water and lines and appurtenances that will be installed at locations other than within publ ~all h ., ' ' : 20 feet wide for each line, dedicated to the City of Poway. Dedication shall be offered on the final/parcel map or by a separate document recorded prior to building permit issuance. All public utility lines (i.e., water, sewer, drainage) not located within public streets shall have an improved access over and along the respective easement, the surfacing and width of which shall be acceptable to the Director of Engineering Services. UTIILITIES All proposed electrical/ :ion/CATV utilities within the project shall be installed underground including existing electrical utilities less than 34.5 KV along Circulation Element roads and/or highways. Cable television services shall be provided and installed underground. The developer shall notify the cable companies when planning, designing and constructing for utilities is to be accomplished. The developer shall notify the City that all cable companies have been notified and are either included in the project or have declined to install their 1' ' the project. Utility easements shall be provided to the specification of the serving utility companies and the Director of Engineering Services. The developer shall be responsible for the and undergrounding of existing public utilities as required. Resolution No. P-97-36 Page 6 Existing telephone, gas, electric, water, sewer, and other public utility lines and apl~ ~all be shown on the grading/improvement plans. All public utility lines (i.e., water, sewer, drainage) not located within public streets shall have an improved access over and along the respective easement, the surfacing and width of which shall be acceptable to the City Engineer. lENTS AND APP The parcel map shall conform to City standards and procedures, City subdivision ordinance, Subdivision Map Act, and Land Surveyors Act. A lation bond in an amount acceptable to the City Engineer shall be posted prior to parcel map approval. Developer shall cleady label th designated as floodway and floodplain, if any, on the parcel map. Development within the floodway/floodplain areas shall comply with the req I Division 4, of the Poway Municipal Code. The applicant shall provide the City with a photo mylar copy of the recorded parcel map within 30 days from its recordation. The following fees, including but not limited to, traffic mitigation, drainage, water base capacity, and park fees shall be paid or secured prior to building permit issuance. If secured, these fees shall be paid in full prior 1 : a certificate of occupancy. Permit and plan checking fees shall be paid upon submittal of parcel map, improvement, and/or grading plan, as applicable. COMPLIANCE WITH THE FOLLOWING CONDITION IS REQUIRED. COMPLIANCE SHALL BE APPROVED BY THE DEPARTMENT OF PUBLIC SERVICES. Connecting the eight-inch (8") drain pipe to the existing publicly :1 concrete drainage channel shall be reviewed and approved by the Engineering Services Department prior to parcel map approval and recordation.
