P- 97-54 A OF THE CITY OF THE CITY OF POWAY, CALIFORNIA APPROVING DEVELOPMENT REVIEW 97-30 ASSESSOR'S PARCEL NUMBER 314-710-39 WHEREAS, Development Review 97-30 submitted by Keith Francis, requests approval t :a 3,600 square foot retail shop building located directly north of the restaurant located on Parcel 4 of Twin Peaks Plaza, at the northeast corner of Pomerado Road and Ted Williams Parkway, in the CG zone; and WHEREAS, on September 30, 1997, the City Council held a hearing on the above referenced item. NOW, THEREFORE, the City Council does hereby follows: S 1: E Iai I The City Council finds that the previously issued Negative Declaration for Tentative Parcel Map 86-03 (Parcel Map 14824) for Twin Peaks Plaza anticipated retail shops being :1 on the subject site and that the eadier investigation adequately discusses the ~ this project. LANDSCAPEIMPROVEMENTS Complete landscape c~ ~all be submitted to and approved by the Planning Services Department prior to the issuance of building permits. Plans shall be prepared in accordance with City of Poway Guide to Landscape Req (latest edition). A Master Plan of the existing on-site trees shall be provided to the Planning Services Department prior to th ! building permits and prior to grading, to d 3ich trees shall be retained. Existing on-site trees shall be retained wherever possible and shall b J in a horticulturally acceptable manner. Dead, decaying, or potentially dangerous trees shall be approved for removal at the discretion of the Planning Services Department during th : the Master Plan of existing on-site trees. Living trees which are approved 1' shall be replaced on a ! basis as required by the Planning Services Department. Pruning should be restricted t the health of the trees and to protect the public safety. Unnatural pruning, including topping, is not permitted. SIGNS Resolution No. P-97-54 Page 4 Any signs proposed for this development shall be designed and approved in conformance with the Sign Ordinance and the comprehensive sign program for Twin Peaks Plaza. COMPLIANCE WITH THE FOLLOWING CONDITIONS IS REQUIRED. COMPLIANCE SHALL BE APPROVED BY THE DEPARTMENT OF ENGINEERING SERVICES. SITE DEVELOPMENT F development, the applicant shall pay development fees at the established rate. The following fees, including but not limited to, traffic mitigation, drainage, water base capacity, sewer line charge, and reimbursement agreement fees shall be paid prior to building permit issuance. Permit and plan check fees shall be paid upon submittal of map, improvement and/or grading plan, as applicable. All other fees, including but not limited to, water service fees, remaining sewer l, and sewer inspection fees shall be paid pdor to building permit issuance. GRADING Grading of the subject property shall be in accordance with the Uniform Building Code, City Grading Ordinance, approved grading plan and geotechnical report, and accepted grading practices. The grading plan shall lificate signed by a registered civil engineer that the grading plan has preserved a ' ' : 100 square feet of for each dwelling unit and for each future building site within the subdivision. A soils report shall be prepared by a qualified engineer licensed by the State of California to perform such work. The final grading plan, prepared on a standard sheet of mylar, shall be subject to review and approval by the Planning and Engineering Services Departments and shall be completed prior to recordation of the final subdivision map : building permit, which first. 5. Resolution No. P-97-54 Page 5 A certification of line and grade, prepared by the project civil engineer, shall be submitted prior to' ! building permits. Buildings and parking lots shall be at least five feet from tops and toes of slopes, unless waived by Planning and/or Engineering Services Departments prior to grading permit issuance. If pad elevation increase by greater than two feet in height from those approved on the 1 3 or on the schematic grading plan used as a basis of approving the project, City Council approval will be required prior to grading permit issuance. Non-supervised or non-engineered fill is specifically not allowed. Rock disposal areas shall be graded in compliance with City-approved soils investigations and :lations and grading plans. E , including but not limited to desiltation basins, shall be installed and :1 from Oct. 15th to Apd115th. An erosion control plan shall be prepared by the project civil engineer and shall be submitted as part of the grading plan. The developer shall make provisions to insure the proper maintenance of all erosion control devices throughout their intended life. AND SIDEWALKS Improvement plans for streets and any other public utility lines, prepared on standard sheets of mylar by a Registered Civil Engineer shall be submitted for approval by the Director of Engineering Services Department. Plan check and inspection fees shall be paid by the developer. All parking lot structural lall be approved by the Director of Engineering Services. Resolution No. P- 97-54 Page 6 Prior to any work performed in the public right-of-way or City-held a right-of-way permit shall be obtained from the Engineering Services Department and appropriate fees paid, in addition to any permits required. ~,ND FLOOD CONTROL drains shall be required at locations specified by the Director of Engineering S :1 in accordance with standard engineering 3ractices. A drainage system capable of handling and disposing all surf '3inating within the project, and all surface waters that may flow onto the project from adjacent lands, shall be required. Said drainage system shall include any -t required by the Director of Engineering Services to properly handle the drainage. 3. Concentrated driveways and/or sidewalks shall not be permitted. UTILITIES All proposed electrical/ lion/CATV utilities within the project shall be installed underground including existing electrical utilities less than 34.5 KV along Circulation Element roads and/or highways. All public utility lines (i.e., water, sewer, drainage) not located within public streets shall have an improved access over and along the respective easement, the surfacing and width of which shall be acceptable to the Director of Engineering Services. ~.ND APPROVALS Resolution No. P-97-54 Page 7 This approval is based on the existing site conditions represented on the proposed site plan. If the actual conditions vary from those rep the site plan must be changed to reflect the actual conditions. Any substantial changes to the site plan must be approved by the Director of Planning Services and the Director of Engineering S :1 may require approval of the City Council. Prior to building permit issuance, appropriate water, sewer, and traffic mitigation fees shall be paid to the City's Engineering Services Department. Based on a building square footage of 3,600 square feet and the type of usage, traffic mitigation fees will not be required. Water fees are based on the meter size and will be determined when the war size is established. San Diego County Water Authority fees shall be paid based on the size of the war Sewer fees are based on either a fixture count or building square footage, based on the proposed use and size of the building, and indirect benefit fees will not be required. A l box fee of $50.00 and sewer inspection fee of $25.00 shall be paid prior to building permit issuance. COMPLIANCE WITH THE FOLLOWING CONDITIONS IS REQUIRED. COMPLIANCE SHALL BE APPROVED BY THE DEPARTMENT OF SAFETY SERVICES. Roof covering shall meet Class A fire retardant testing as specified in the Uniform Building Standards No. 32-7 for fire retardant roof covering materials, per City of Poway Ordinance No. 64. The buildings shall display their numeric address in a manner visible from the :. M : building numbers is 6 inches on facade of building.
