A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
APPROVING VARIANCE 97-10
AND DEVELOPMENT REVIEW 97-44
ASSESSOR'S PARCEL NUMBERS 317-280-37-00, 317-280-38-00,
AND 317-280-39-00
WHEREAS, Variance 97-10 and Development Review 97-44, submitted by
American Property Enterprises, Applicant, requests approval for the construction of four
industrial buildings on three lots. The applicant is also requesting ' ~)proval to
allow: 1 ) variance for parking and driveway setback along Scripps Poway Parkway from
50' to 35'; 2) variance for building setbacks along Danielson Street from 35' to 25'; and, 3)
vadance 1' l sign along Scripps Poway Parkway to locate the sign within the 35'
setback. The lots are designated as light industrial and are located within the South Poway
Planned Community zone; and
WHEREAS, on January 6, 1998, the City Council held a duly advertised public
hearing to solicit from the public, both pre and con, relative to this application.
NOW, THEREFORE, the City Council does hereby
follows:
The potential impacts of the project were addressed by the previously Certified Final EIR
and Final Subsequent EIR for the South Poway Planned Community.
Variance 97-10
That there are special 3plicable to the property, and because of
this, the strict application of the Zoning Code deprives the property of privileges
enjoyed by other properties in the vicinity with the identical land use designation.
The special include the fact that the three-lot proposal has been
planned comprehensively with consideration for scale, location, orientation and
architectural style of the development to provide a well designed and balanced
project; the landscape berm will be high enough (4 to 6 feet high) to screen cars
parked behind it. Portions of the frontage will have the full 50 foot depth of
landscaping and the 50 foot setback will be observed for the buildings.

vicinity and land use designation for which the variance is sought in that similar
development has been allowed on other industrial lots that have been developed

The development will not have an adverse aesthetic, health, safety, or
architecturally related impact upon adjoining properties, because the site and the
buildings have been designed in accordance with the Specific Plan area
development plan with consideration for scale, size, orientation and architectural
style to provide a well balanced project.
The development is in compliance with the South Poway Development Standards
and the South Poway Planned Community Development Plan with exception of the
requested variance for parking and ddveway setback along Scdpps Poway Parkway

All parking lot landscaping shall include a ' ' "one 15 gallon size tree for
every three spaces. For parking lot islands, a minimum 12 inch wide walk
adjacent to parking stalls shall be provided and be separated from vehicular
areas by a six inch high, six inch wide portland I curb.
2. All parking spaces shall be double striped. The parking lot design shall comply
with the A Ih Disabilities Act, i.e. 1:25 ratio 1' 31e spaces with
one van accessible space.
3. Parking lot lights shall be Iow p :lium and have a height of 25
feet from the finished grade of the parking surface and be directed away from all
property lines, adjacent :1 buildings on adjacent lots.
LANDSCAPING
1. A detailed landscape and irrigation plan shall be submitted to and approved by
the Planning Services Department prior to the ' ~ building permits.
All landscaped areas shall be maintained in a healthy and thriving condition, free
from weeds, trash and debris.
3. Use of recycled water will be required for on-site landscape irrigation. Each site
shall have a designated user supervisor who has attended the San Diego
County Water authority user sul; County of San Diego Dept. of

INDUSTRIAL
Roof covering shall be fire retardant as per UBC Section 3203(e) and City of
Poway Ordinance No. 64.

Installing Fire Sprinkler and Underground Fire Service Contractor(s) shall obtain
a copy of the fire department's 'stems.

properly licensed contractor. System shall be completely monitored by a U.L.
listed central star 3any or proprietary :ion.
A Knox Security Key Box shall be required for the building at a location
determined by the City Fire Marshal. A Knox padlock shall be required for the
fire sprinkler system Post Indicator Valve.
Fire Department access for use of fire fighting equipment shall be provided to the

times until construction is completed.

Permanent access roadways for fire apparatus shall be designated as 'Fire
Lanes' with appropriate signs and curb markings.
Minimum 4A:60BC fire extinguisher required for every 3000 square feet and 75'
travel distance. A 2A:10BC fire extinguisher(s) are required for off' 'y
3,000 square feet and 75' of travel distance.

Material Safety Data Sheets shall be required for all hazardous and/or toxic

An Emergency Continency Plan and Hazardous Materials D lall be
filed with the County of San Diego Department of Health and copies provided to
the Fire Department.
Prior to delivery of combustible building material on site, water and sewer
systems shall y pass all required tests and b :l to the public
water and sewer systems. In addition, the first lift of asphalt paving shall be in
place to provide adequate, permanent access for emergency vehicles. The final
lift of asphalt shall not be installed until all otb :y has been
substantially completed to the sa! '* the City.
N.F.P.A. Standard 704, Hazardous Materials Labeling, shall be provided as
necessary throughout the building.

SERVICES.
GRADING
1.
Grading of the subject property shall be in accordance with the Uniform Building
Code, City Grading Ordinance, approved grading plan and geotechnical report,
and accepted grading practices.
A grading plan for the development of the property, prepared on a standard
sheet of mylar and drawn at a scale of 1" = 20, shall be submitted to the City's
Engineering Services Department 1' '~ approval prior to ' f a
grading permit and start of grading operation. Rough grading of the site must be
completed and shall meet the City's Engineering S 3ector's approval
prior to ' : a building permit.
A soils report shall be prepared by a qualified engineer licensed by the State of
California to perform such work. Copies of the report shall be submitted with the
grading plan.

A final compaction report shall be submitted and approved prior
building permits.
A certification of line and grade, prepared by the project civil engineer, shall be
submitted prior1 =building permits.
Erosion control, including but not limited to desiltation basins, shall be installed
and :1 from Oct. 15th to April 15th. An erosion control plan shall be
prepared by the project civil engineer and shall be submitted as part of the
grading plan. The developer shall make provisions to insure the proper
f all erosion control devices throughout their intended life.
Paving of the parking lot shall conform to the standards as set forth in Section
12.20.080 of the City Code.
