A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
APPROVING MINOR DEVELOPMENT REVIEW 97-85
ASSESSOR'S PARCEL NUMBER 278-301-21
WHEREAS, Minor Development Review 97-85, submitted by Russell and Meredith
Anderson, Applicants, requests that the staff approval of the minor development review for
the construction of a new single family home be upheld by the Poway City Council for the
property located on a 2.54 acre lot on White Vale Lane within the RR-B zone; and
WHEREAS, on February 9, 1998, the applicant appealed the condition of approval
set forth by the Safety Services Department of staff's approval which states: "Current 'dog
leg' the adjacent lot must meet policy of a 28' radius on the inside and 48' radius
on an outside angle"; and
WHEREAS, the Safety Services Department position is that imped' ~ as
substandard access design can h :luences which may affect both life safety and
property p Staff :Is that the appeal be denied and all conditions
contained within the original approval letter dated February 2, 1998 shall remain in full
force and effect; and
WHEREAS, on March 10, 1998 a hearing was held to solicit comments regarding
appeal of the staff approval, and having taken publ ; both pro and con, relative
to this application.
NOW, THEREFORE, the City Council does hereby
follows:
The City Council finds that a Minor Development R 3t from under the
provisions of the California E Quality Act, Class 3, as a residential
:I accessory structure.
The turning radius design req Iilized by the Department of Safety
Services have been referenced since the early 1980's and are regional
standards intended to provide adequate access for responding fire
apparatus. It is important to retain this design standard so that apparatus
from the City of Poway, San Diego, Rancho Santa Fe, or within the region
can obtain unimpeded access. These aG y respond into our
community to assist with the delivery of fire protection.

It is important to note that the subject property is within the High Valley
region which presents significant challenges in the area of fire protection.
Recent imp to the primary access roads will serve to assist
responding agencies. However, the large areas of combustible fuels (brush,
chamise, and chaparral) make this a region to remain diligent in applying
current design standards. The Safety Services Department position is that
imped ~ as substandard access design can h quences
which may affect both life safety and property preservation.

The City Council hereby approves Minor Development Review 97-85 subject to the
following conditions:
All conditions contained within the original approval letter dated February 2, 1998
shall remain in full force and effect. The following language shall be added to
condition # 25:
The City shall lend the power of eminent domain to the applicant as
necessary to satisfy this condition. The Council finds that the public
safety so requires. All costs shall be borne by the applicant.
APPROVED AND ADOPTED by the City Council of the City of Poway, State of California,
this 10th day of March, 1998.
