P- 98-].8 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA APPROVING MINOR DEVELOPMENT REVIEW 98-07 ASSESSORS PARCEL NUMBER 277-020-22 WHEREAS Minor Development Review 98-07, submitted by Greg Agee, Applicant, for the purpose of ' .~ a 4,507 square foot, single story resid vacant 8.3 acre property located at 14940 Oak Trail Court within the Rural Residential A zone. WHEREAS, on March 24, 1998, the City Council held a duly advertised public headng to solicit from the public, both pro and con, relative to this application. NOW, THEREFORE, the City Council does hereby follows: The City Council hereby finds that the project is not subject to the California E Quality Act in that it is th : a single family home. S ( The development will not have an adverse aesthetic, health, safety, or architecturally related impact upon adjoining properties, because the house has been designed so that it is architecturally compatible with the development :ling residential properties. 2 The development encourages the orderly and h appearance of sl :l property within the City through it ! with the high standards for residential development throughout the City. COMPL NCE WITH THE FOLLOWING CONDITIONS IS REQUIRED. COMPLIANCE SHALL APPROVED BY THE DEPARTMENT OF PLANNING SERVICES. 6 10. Resolution No. p-98-18 Page 2 ~nt Site shall be developed in accordance with the approved site plans on file in the Planning Services Department and the conditions contained herein. Revised site plans and building incorporating all conditions of approval shall be submitted to the Planning Services Department prior to I building permits. The applicant shall pay all applicable fees, including school fees, which are presently $1.84 per square foot of assessable space (living area) prior to building permit issuance. The fee amount shall be based on the rates in effect at the time of building permit issuance. Effective April 20, 1998, the school fees will increase to $1.93 per square foot of assessable space. Prior to final occupancy the applicant shall provide d 3owing that the biological easement required with MDRA 97-70 was recorded on the subject property. The developer shall pay an Affordable Housing In-Lieu Fee in the amount of $4,500 ( based on a 4,507 square foot residence). Approval of this request shall not 31lance with all i the South Poway Development Standards the Zoning Ordinance and all other applicable City Ord ~ect at the time of building permit issuance. Future grading of the hillside portions of the subject lot shall be prohibited unless approved by the City Council. All created or cleared slopes of 5:1 or greater shall be landscaped and irrigated prior to final occupancy. 17. The proposed location of the required water tank for fire fighting shall be reviewed and approved by the Planning Services Department prior to installation. This approval shall b I and void if building I: not issued for this project within two years from the date of project approval. COMPLIANCE WITH THE FOLLOWING CONDITIONS IS REQUIRED. COMPLIANCE SHALL BE APPROVED BY THE DEPARTMENT OF SAFETY SERVICES. Roof covering shall meet Class A fire retardant testing as specified in the Uniform Building Standards No. 32-7 for fire retardant roof covering per city of Poway Ordinance #64. Approved numbers or addresses shall be placed on the building in such a position as to be plainly visible and legible from the street fronting the property. Resolution No. p_98-18 Page 4 A residential fire sprinkler system with a one inch meter will be required. Plans shall be submitted to the Fire Prevention Bureau for approval prior to installation (if a one inch lateral off the street main is currently not present, one will have to be installed.). This dwelling is being built on a parcel size of 8.3 acres and is beyond 500 feet from the nearest fire hydrant. The dwelling will have to have standby water for firefighting and a residential sprinkler system. Contact the Fire Prevention Bureau for details. A 10,000 gallon water tank with a fire department shall be installed. Contact the fire department for location and installation details. The access roadway shall be extended to within 150' of all portions of the exterior walls of the first story of any building. Where the access roadway cannot be provided, approved fire p ./stem(s) shall be provided as required and approved by the Chief. COMPLIANCE WITH THE FOLLOWING CONDITIONS IS REQUIRED. COMPLIANCE SHALL BE APPROVED BY THE ENGINEERING SERVICES DEPARTMENT. The applicant shall pay a $500.00 inspection fee to the City's Engineering Services Department prior to building permit issuance. Such fee is to be used to pay for City Inspector's time in making necessary inspections of the project site that are required prior t I said building permit and/or Certificate of Occupancy. A right-of-way permit shall be obtained from the City's Engineering Services Department for any work to be done within the public street right-of-way or any City-held easement. Said work shall include, but is not limited to, f driveway approach, sewer lateral installation, line installation, and street construction. Any modification to the approved grading which will result in th of more than 50 cubic yards requires approval from the Director of Engineering Services, or a separate grading permit to be obtained prior to start of grading operation. Additional plan check and inspection fee may be required. 4 Resolution No. P- 98-18 Page 5 The total disturbed area on the site may not exceed the combined totals of the building envelope, area graded for the ddveway and slop J by the road grading. Native vegetation shall be retained in areas beyond the limits of grading. The private road adjacent to and/or within the property commonly referred to as Oak Creek Trail, shall be improved to City of Poway's Non-dedicated Rural Road Standards per Ordinance No. 280. Its completion thereof shall be done prior I f building's Certificate of Occupancy. A private road and agreement, for Oak Creek Trail, in a form satisfactory to the City Attorney, shall be executed by the owner and/or developer prior to building permit issuance. Said agreement is to comply with Ordinance No. 280, City Code Section 12.20.060. Leach field layout or seepage pit layout for the resid .~e disposal system shall be submitted to the City's Engineering Services Department for review and approval by the City Engineer prior to obtaining a septic system installation permit from the County of San Diego Department of Health. If a septic sy lation permit had been obtained without a City approved layout, one shall be submitted pdor to installation of leach lines. The following development fees shall be paid to the Engineering Services Department prior to building permit issuance. These fees are currently in effect and are subject to change. Sewer and water fees are only required if proposed residence is going to hook up to the City facilities. The following fees shall be paid or a security bond posted prior 1 of a building permit. If a security bond is posted, payment of the fees shall be made prior issuance of a Certificate of Occupancy. Once payment is received in full said security bond could be released to the applicant.
