P- 98-28 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA APPROVING TENTATIVE PARCEL MAP 98-07 ASSESSOR'S PARCEL NUMBER 320-020-33 WHEREAS, Tentative Parcel Map 98-07, submitted by Laura Lyle Kimball proposes to divide a 0.92 acre property into two residential parcels. The subject property is located at 11508 Creek Road within the Creek Road E :the South Poway Planned Community zone; and WHEREAS, on May 12, 1998, the City Council held a hearing on the above- J item. NOW, THEREFORE, the City Council does hereby follows: The City Council hereby issues a Negative Declaration with Mitigation Measures (indicating no significant adverse impacts anticipated due to the addition of special req to the project). The approved project' I with the General Plan, the South Poway Specific Plan and the Creek Road Enclave Development Standards in that it proposes to create two residential parcels from a lot designated for residential use. The design and imp required of the tentative parcel map are consistent with all applicable general and specific plans; in that the approved parcel sizes and config :lhere to the development standards for the Creek Road E ':lential area. The site is physically suitable for the type of development and the density proposed; in that the site is large enough to provide two parcels, each relatively regular in shape and with d lich are in keeping with the Creek Road E ':lential development standards. The design of the subd : likely 1 3stantial damage and avoidable injury to h :1 wildlife or other habitat in that the site has been completely disturbed and any road improvement work in or near the small bi < that runs through the southeast comer of the -- Resolution No. P- 98-28 Page 2 o property will require California Fish and Game approvals and permits prior to the approval of a City grading or improvement plan. The tentative pamel map is not likely 1 in that City water and public health problems 31e to the property. The design of the tentative parcel map will not conflict with any easement by the public at large, now of record, 1' through or use of the property within the proposed subdivision. The City Council hereby approves Tentative Parcel Map 98-07 subject to the following conditions: Within 30 days of approval, the applicant shall submit in writing that all conditions of approval have been read and understood. COMPLIANCE WITH THE FOLLOWING CONDITIONS IS REQUIRED. COMPLIANCE SHALL BE APPROVED BY THE DEPARTMENT OF PLANNING SERVICES. The property however is presently eligible for an approval of a waiver of the requirement to underground. In the event that the applicant chooses to pursue an undergrounding waiver, the required application and fee shall be submitted to the Planning Services Department 1' The approval of this tentative parcel map shall expire at the end of two years if either a parcel map has not been approved and recorded or a time extension has not been sought by Map 12, 2000. Low landscaping shall be maintained along the existing driveway entrance to insure optimum sight visibility. A Minor Development Review shall be accomplished prior to the issuance of a building permit on Parcel 1. COMPLIANCE WITH THE FOLLOWING CONDITIONS IS REQUIRED. COMPLIANCE SHALL BE APPROVED BY THE DEPARTMENT OF ENGINEERING SERVICES. ~.DING Grading of the subject property shall be in accordance with the Uniform Building Code, City Grading Ordinance, approved grading plan and geotechnical report, and accepted grading practices. A grading plan is not required if grading involves earthwork I of less than 50 cubic yards. If no grading is required, certification f ,]istered civil engineer indicating the amount of earthwork shall be furnished to Engineering $ :1 a $500.00 inspection fee shall be paid prior to building permit issuance. The grading plan shall 'tificate signed by a registered civil engineer that the grading plan has preserved a ' ' 1100 square feet of for each dwelling unit and for each future building site within the subdivision. = A soils report shall be prepared by a qualified engineer licensed by the State of California to perform such work. Copies of the report shall be submitted with the grading plan. 4. All new slopes shall b ~2:1 (horizontal to vertical). A certification of line and grade, prepared by the project civil engineer, shall be submitted prior t : building permits. Resolution No. P- 98-28 Page 4 10. Non-supervised or non-engineered fill is specifically not allowed. Rock disposal areas shall be graded in compliance with City-approved soils investigations and :lations and grading plans. E ' including but not limited to desiltation basins, shall be installed and :1 from Oct. 15th to Apdl 15th. A plan shall be prepared by the project civil engineer and shall be submitted as part of the grading plan. The developer shall make provisions to insure the proper of all erosion control devices throughout their intended life. Improvement plans for the private road prepared on standard sheets of mylar by a registered civil engineer, shall be submitted to the City's Engineering Services Department f :1 approval. Plan check and inspection fees shall be paid by the developer. The final grading plan, prepared on a standard sheet of mylar, shall be subject to review and approval by the Planning and Engineering Services Departments and shall be completed prior to start of grading operation. A pre-blast survey of the surrounding property shall be conducted to the satisfaction of the City Engineer prior to any rock blasting. A blasting permit shall be obtained from the Engineering Services Department prior to any rock blasting. Seismic recordings shall be taken for all blasting and blasting shall occur only at locations and levels approved by the City Engineer. UTILITIES All proposed electrical/ /CATV utilities within the project shall be installed underground including existing electrical utilities less than 34.5KV along Ciroulation Element roads and/or highways. Existing telephone, gas, electric, water, sewer, and other public utility lines and appurt ~all be shown on the grading plans. Utility easement shall be provided to the si; and the Director of Engineering Services. =the serving utility companies Cable television services shall be provided and installed underground. The developer shall notify the cable companies when planning, designing and constructing for utilities is to be accomplished. The developer shall notify the City that all cable companies have been notified and are either included in the project or have declined to install their facilities in the projects. _ Resolution No. P- 98-28 Page 5 Water and sewer system shall be designed and :1 to meet the req :the City of Poway and San Diego County Department of Health. Fire hydrants shall be installed at locations to be determined by the City Fire Marshal. A water s~ ysis shall be prepared to establish the proper size and location of the public water system if necessary. Multiple parallel facilities will require additional easement width for on-site facilities. Dedication shall be offered on the final/parcel map or by a separate document recorded prior to building permit issuance. All public utility lines (i.e., water, sewer, drainage) not located within public streets shall have an improved access over and along the respective easement, the surfacing and width of which shall be acceptable to the Director of Engineering Services. GENERAL REQUIREMENTS A right-of-way permit shall be obtained from the City's Engineering Services Department for any work to be done within the public street right-of-way or any City- held easement. Said work shall include, but is not limited to, of driveway approach, sewer lateral installation, water service line installation, and street The parcel map shall conform to City standards and procedures, City subdivision ordinance, Subdivision Map Act, and Land Surveyors Act. All :l/or right-of-way dedications to the City that is/are within the limits of a subdivision shall be made on the parcel map. All off I dedications, by a sel: :(s) other than a map, shall be recorded pdor to parcel map approval. Applicant shall improve Creek Road to the City of Poway Ordinance req including but not limited to right of way width, pavement, bridge, drainage channel, culvert or any drainage structures. Developer shall clearly label th designated as floodway and floodplain, if any, on the parcel map. Development within the floodway/floodplain area shall comply with the req : Division 4, of the Poway Municipal Code. The following development fees shall be paid to the Engineering services Department prior to building permit issuance for each residence.
