Res P-98-36RESOLUTION NO. P-98-36 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA APPROVING DEVELOPMENT REVIEW 97-29 MODIFICATION AND RESCINDING RESOLUTION NO. P-97-55 ASSESSOR'S PARCEL NUMBERS 277-190-03 & 06 WHEREAS, Development Review 97-29 Modification for Old Coach Collection, submitted by Greystone Homes, applicant, requests approval for a detached two car garage for Lot 17 and to substitute a two-story home for a one-story home on Lot 20, located at 13630 & 13660 White Wood Canyon, west of Butterfield Trail, north Poway. WHEREAS, on June 16, 1998, the City Council held a hearing on the above~ referenced item. NOW, THEREFORE, the City Council does hereby follows: The modification of the approved development review is consistent with the Old Coach Golf Estates project for which a Final E Impact Report (EIR) (State Clearinghouse #90010015) was certified by the City Council on May 15, 1990. The City Council hereby approves Development Review 97-29 Modification and rescinds Resolution No. P-97-55 subject to the following conditions: Within 30 days of approval (1) the applicant shall submit in writing that all conditions of approval have been read and understood. COMPLIANCE WITH THE FOLLOWING CONDITIONS IS REQUIRED. COMPLIANCE SHALL BE APPROVED BY THE DEPARTMENT OF PLANNING SERVICES. EVELOPMENT Site shall be developed in accordance with the approved site and plotting plans on file in the Planning Services Department and the conditions contained herein. Greystone Homes will be given flexibility on lots proposed for one-story models, They will also be allowed to substitute two-story models for one-story model lots where the lots do not border StoneRidge lots. No new two-story models adjacent to StoneRidge lots will be allowed without City Council approval. The plotting shall be revised to place a Plan 3 (two-story model) on Lot 36 and a Plan 1 (one-story model) on Lot 38. A detached two car garage shall be shown for Lot 17 and a two- story home shall be shown for Lot 20. Revised site plans and building incorporating all conditions of approval shall be submitted to the Planning Services Department prior I : building permits. Approval of this request shall not waive compliance with all sections of the Old Coach Planned Community Development Plan, Zoning Ordinance and all other applicable City Ordinances in effect at the time of building permit issuance. For each new residential dwelling unit, the applicant shall pay Permit, Plan Check and Inspection Fees and School Fees, at the established rate (in accordance with City-adopted policy and/or ordinance). Street names shall be approved by the Planning Services Department prior to the recordation of the final map, and street addresses shall be provided prior to the : building permits. Resolution No. P- 98-36 Page 4 ADDI'I' The developer shall display a current Zoning and Land Use Map, or suitable alternative, in the sales office at all times, to the satisfaction of the Director of Planning Services. All sales maps that are distributed or made available to the public shall include but not be limited to trails, future and existing schools, parks, and streets. The developer shall provide a noise display board in the sales office to the satisfaction of the Director of Planning Services. The display shall include the site plan and noise study information. Working drawings shall include a certification by a recognized acoustical expert that the requirements of the City of Poway's Noise Ordinance will be met. At the completion of and prior to occupancy, interior and exterior CNEL shall be determined by field testing at developer's expense. Tests to be conducted by a recognized acoustical expert. No occupancy permits shall be granted until this test is met to the satisfaction of the Building Code (latest adopted edition) "Sound T Control". A copy of the Covenants, Conditions and Restrictions(CC&R's) and/or Articles of Incorporation of the H Association shall be subject to the review for compliance with conditions herein, to the satisfaction of the City Attorney and Director of Planning Services, and shall be filed with the Secretary of State, the County Recorder and the City Clerk at the time of final map consideration. COMPLIANCE WITH THE FOLLOWING CONDITIONS IS REQUIRED. COMPLIANCE SHALL BE APPROVED BY THE DEPARTMENT OF ENGINEERING SERVICES. All engineering related conditions of approval for Tentative Tract Map 89-13R and Tentative Parcel Map 92-04 contained in Resolutions P-95-09, P-92-67, P-90-097, P-90-91 and P-90-34 remain in effect. Prior to building permit issuance, first lift of AC pavement in the streets shall be in place. COMPLIANCE WITH THE FOLLOWING CONDITIONS IS REQUIRED. COMPLIANCE SHALL BE APPROVED BY THE DEPARTMENT OF SAFETY SERVICES.
