A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
APPROVING MINOR DEVELOPMENT REVIEW 98-39
ASSESSORS PARCEL NUMBER 314-650-30
WHEREAS Minor Development Review 98-39 (Hillside/Ridgeline), was submitted
by David and Katherine Barto, Applicants, for the purpose of constructing a 2,508 square
foot, single story resid 5.0 acre property located at 14825 Midland Road within
the Rural Residential A zone; and
WHEREAS, on July 28, 1998, the City Council held a hearing to solicit comments
from the neighboring property owners, both pro and con, relative to this application.
NOW, THEREFORE, the City Council does hereby
follows:
The City Council hereby finds that the project is exempt under the p ' ' : the
California E ~ Quality Act, Class 3, in that it is th : a single
family home.
The property falls within the Poway Subarea Habitat C Plan preserve
area. Mitigation for the removal of coastal sage scrub and/or chaparral or mixed
chaparral plant communities is required prior to th a grading permit.
The development will not have an adverse aesthetic health, safety, or
architecturally related impact upon adjoining properties, because the house
has been designed so that it is amhitecturally compatible with the
development on the hillside and surrounding residential properties.
The development encourages the orderly and h appearance of
structures and property within the City through it. ./with the high
standards for residential development throughout the City. It is a single-
story, Iow profile, relatively small home with detached garage, with finishes
and ~ich will blend with the natural surroundings.
The City Council hereby approves Minor Development Review 98-39 subject to the
following conditions:

Site shall be developed in accordance with the approved site plans on file in
the Planning Services Department and the condir :1 herein.
Revised site plans and building elevations incorporating all conditions of
approval shall be submitted to the Planning Services Department prior to
: building permits.
The applicant shall pay all applicable fees, including school fees, which are
presently $1.93 per square foot of assessable space (living area) prior to
building permit issuance. The fee amount shall be based on the rates in
effect at the time of building permit issuance.
Prior to final occupancy the applicant shall provide (~ showing
that a biological conservation easement required with MDRA 98-39 is
recorded on the subject property.
The developer shall pay an Affordable Housing In-Lieu Fee in the amount of
$4,008 ( based on a 2,508 square foot residence).
Approval of this request shall not 31iance with all I the

time of building permit issuance.

The applicant shall comply with the latest adopted Uniform Building Code,
Uniform Mechanical Code, Uniform Plumbing Code, National Electric Code,
Uniform Fire Code, and all other applicable codes and ord fect
at the time of building permit issuance.
Future grading of the hillside portions of the subject lot shall be prohibited
unless approved by the City Council.
All created or cleared slopes of 5:1 or greater shall be landscaped and
irrigated prior to final occupancy.

reviewed and approved by the Planning Services Department prior to

SERVICES.
Roof covering shall meet Class A fire retardant testing as specified in the
Uniform Building Standards No. 32-7 for fire retardant roof covering
materials, per City of Poway Ordinance #64.
Approved numbers or addresses shall be placed on the building in such a
position as to be plainly visible and legible from the street fronting the
property. Said numbers shall contrast with their background. Address shall
be required at private driveway entrances.

*Curves and topographical conditions could alter the requirements for
turnarounds and the width of ys.
The access roadway shall be extended to within 150' of all portions of the
exterior walls of the first story of any building. Where the access roadway
cannot be provided, approved fire p jstem(s) shall be provided as
required and approved by the Chief.
This dwelling is being built on a parcel size of 5 acres and is beyond 500 feet
from the nearest fire hydrant. The dwelling will have to have
standby water for fireflghting and a residential sprinkler system. Contact the
Fire Prevention Bureau for details.
A residential fire sprinkler system with a one inch meter will be required.
Plans shall be submitted to the Fire Prevention Bureau for approval prior to
installation (if a one inch lateral off the street main is currently not present,
one will have to be installed).
Provide a 10,000 gallon water tank with a 4" underground line supplying a
2 W' discharge within 50' of the house. The location of the discharge will be
located by the Fire Prevention Bureau upon plan submittal.
Applicants shall comply with City Landscape req for fire zones.
Consult the landscape guidelines document, available in the Planning
Services Department.

If city water is going to be used, a private booster pump will be needed. The
booster pump should be installed at a elevation of 740' or at a

Grading plan for the development of the property shall be submitted to the
City's Engineering Services Department for review and approval prior to
: a grading permit and start of grading operation unless grading
involves earthwork l of less than 50 cubic yards, if no grading is
required, a certification tRegistered Civil Engineer indicating the
amount of earthwork shall be furnished to said City's Engineering Services
Department and a $500.00 inspection fee shall be paid prior to building
permit issuance.
Erosion control, including but not limited to desLLtation basins, shall be
installed and :1 from Oct. 15 to April 15. An erosion control plan
shall be prepared by the project Civil Engineer and shall be submitted as part
of the grading plan. The developer shall make provisions to insure the proper
maintenance of all lrel devices throughout their intended life.
A drainage system capable of handling and disposing all surface water
originating within the project, and all surface waters that may flow onto the
project from adjacent lands, shall be requLred. Said drainage system shall
include any and as required by the Director of
Engineering Services to properly handle the drainage.
Leach field or seepage pit layout for the residential sewage disposal system
shall be submitted to the City's Engineering Services Department for review
and approval by the City Engineer prior to obtaining a septic system
installation permit from the County of San Diego Department of Health. If a
septic sy lation permit had been obtained without a City approved
layout, one shall be submitted prior to installation of leach lines.
A right-of-way permit shall be obtained from the City's Engineering Services
Department for any work to be done within the public street right-of-way or
any City-heLd easement. Said work shall include, but is not limited to,
constructLon of driveway approach, sewer lateral installation, war
line installation, and street
