Res P-98-50RESOLUTION NO. P-98-50 A RESOLUTION OF THE CiTY COUNCIL OF THE CITY OF POWAY, CALIFORNIA CONCERNING PARCELS 3 AND 4 MODIFYING RESOLUTION NO. P-92-67, TENTATIVE PARCEL MAP 92-04, PART OF TENTATIVE TRACT MAP 89-13 REVISED (2) ASSESSOR'S PARCEL NUMBER APN: 277-170-01, 04; 277-171-26 WHEREAS, Tentative Tract Map 89-13 Revised (2), hereinafter "Map" submitted by E Development, Inc., Bruce Tabb, applicant, for the purpose of modifying the conditions of TTM 89-13R Old Coach Golf Estates for Phase 2 of 78 residential lots and a golf 549 acres of the 708 acre Planned Community (PC) zone/specific plan site on the real property situated in the City of Poway, County of San Diego, State of California, described as the portion of Section's 18, 19 and 30, Township 13 North, Range One West, San Bemardino Base Meridian and a portion of Section 24 and 25, Township 13 South, Range 2 West San Bernardino Base Meridian; and WHEREAS, the Director of Planning Services has :led approval of the modification of the conditions of'l-rM 89-13R Old Coach Golf Estates for Phase 2 of 78 residential lots and a golf 549 acres of the 708 acre specific plan site for the map subject to all conditions set forth in the Planning Services Department report; and WHEREAS, the City Council has read and considered said report and has considered other evidence presented at the public hearing. The site is physically suitable for the density of the development approved; in that the proposed lots meet the acreage req of the specific plan and underlying RR-A, B and C zones. The design of Parcels 3 and 4 of the parcel map is not likely 1 ~)stantial damage and avoidable injury to h :1 wildlife or their habitat, because appropriate mitigation have been identified by the project EIR and will be implemented with project construction. The development of Parcels 3 and 4 of the tentative parcel map is not likely to public health problems, because City water and I be provided to the new parcels. Low flow plumbing fixtures will be required throughout future buildings on the site. Landscaping plans will eventually be prepared with minimal 3tion and incorporating I ' '.;lation techniques for trees and shrubs. The design of Parcels 3 and 4 of the tentative parcel map will not conflict with any easement acquired by tl~e public at large, now of record, 1' through or use of the property within the proposed subdivision. The project will not create adverse impacts on the I, because it is a modification to a prior land division and golf course, and the underlying Tract Map 89-13R will comply with all req t the project EIR. I; Resolution No. P-98-50 Page 3 All existing conditions of approval of this project ~ect except as modified below: Within 30 days of approval, the applicant shall submit in writing that all conditions of approval have been read and understood. = Prior to any clearing, brushing, or grubbing of areas not already cleared, or approved for clearing an Ad Clearing Permit shall be obtained from the Departments of Planning and Engineering Services. = The developer shall design and construct a water system for the transportation of reclaimed water throughout the project in accordance with Poway's Master Plan. Said shall be complete within six months of availability of reclaimed water. This condition supersedes Condition No. 6 on Page 13 of Resolution No. P-90-91. The applicant shall enter into a contract with the City of Poway for service of reclaimed water at a market rate when it I: ~le. Old Coach Road shall be constructed as a 40 foot graded level width (28 foot curb to curb paved road with a 10 foot hiking/equestrian trail along the east side and deletion of the sidewalk on the west side) within a 60 foot right-of-way and a design speed of 35 mph. The segment of Old Coach Road immediately north of Espola Road from the traffic signal approximately 500 feet north will be designed and constructed for a 30 mph design speed and signed accordingly. Where the trail is not adjacent to the roadway, a six foot wide shoulder shall be provided for utilities. A total width of 41 feet will be provided in the bridge araa: four foot clear with six inch curb on the west side, a nine foot wide recreational trail with six inch curb on the east side, guard rails for safety, and a 28 foot roadway. A portion of Old Coach Way is renamed Old Coach Drive as shown with Old Coach Way continuing as the street name to the north. Resolution No. P-98-50 Page 5 Temporary Use Permit 98-47 is approved to allow the construction of an 1,120 square foot temporary sales pavilion on the east side of Old Coach Road about 500 feet north of Espola Road subject to the conditions in the attachment to the agenda report. Gating of the streets at the street ' for Lots 1 through 7 and at the intersection of Old Coach Road with Old Coach Way (proposed to be Old Coach Drive) is approved. The developer shall prepare for City review and approval, a detailed proposal for the use, operation, and maintenance of all proposed entry gates to p ~,hin the development. All gated entries shall operate to the satisfaction of the Safety $ :1 Sheriff's Departments.
