P- 98-61 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA APPROVING LIGHTING EXEMPTION 98-01 FOR CIRCLE K STORE ASSESSOR'S PARCEL NUMBER 321-190-29 WHEREAS, a request for approval of the use of Iow wattage high-p Jium lamps for the under canopy lights at the Circle K store located at 14147 Twin Peaks Road has been received from Tosco/Circle K; and WHEREAS, Staff has examined the proposal for the change and the Planning Director has completed a report and :lation to the City Council .;I the changes; and WHEREAS, nearby neighbors have been consulted as to the modifications; and NOW, THEREFORE, the City Council does hereby follows: The subject project is found to be categorically exempt Class 2, under the provisions of the California E Iai Quality Act, the replacement or "existing ri facilities. The approved project is consistent with the general plan in that overall project enhances a neighborhood 3ich is permitted in areas. The approved project will not have an aC: :hetic, health, safety, or architecturally related impact upon adjoining properties because the lights being discussed herein will be installed in such a way that neither their intensity nor their light beam spread will b to nearby residents. The City Council hereby app :lification/exemption to the requirement for the use of Iow p iium lights in favor of high p Jium, Iow wattage lighting under the pump island canopy, subject to the following conditions: Within 30 days of approval, the applicant shall submit in writing that all conditions of approval have been read and understood. Resolution No. P-98-61 Page 2 COMPLIANCE WITH THE FOLLOWING CONDITIONS IS REQUIRED. COMPLIANCE SHALL BE APPROVED BY THE DEPARTMENT OF PLANNING SERVICES. The applicant shall change out the lamps mounted under the pump island canopy to high p 'lium type with wattage limited I 250 watts per light fixture. Shielding shall be installed on each fixture to accomplish satisfactory control of light beam spillage onto adjacent properties and the public roadway, to the satisfaction of the Director of Planning Services. The appropriate building permits shall be obtained prior to any work being conducted. On January 5, 1999, the City Council will review a progress report 3 the progress of this retrofit project. At that time testimony will be solicited from surrounding neighbors in order to determine if further modification is necessary.
