A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
APPROVING MINOR DEVELOPMENT REVIEW 98-35
ASSESSOR'S PARCEL NUMBER 321-220-15
WHEREAS, Hillside/Ridgeline Minor Development Review 98-35, submitted by Bill
Murray, Applicant, for the purpose of constructing a 3,021 square foot, two-story, split level
residence on a vacant hillside property located at 14456 Golden Sunset Lane within the
Rural Residential B High Valley zone.
WHEREAS, on November 10, 1998, the City Council held a duly advertised public
hearing to solicit from the public, both pro and con, relative to this application.
NOW, THEREFORE, the City Council does hereby
follows:
The City Council hereby finds that the project is Categorically Exempt
(Class 3) from the California E Iai Quality Act in that it is the
construction of a single family home.
The City Council hereby finds that in accordance with the Poway Habitat
Conservation Plan the required findings for approval of any proposed
mitigation for the removal of coastal sage scrub are as follows:
The mitigation is consistent with and furthers the implementing
objectives of the Poway Habitat Conservation Plan in that the
developer is required to mitigate any removed habitat at a 1:1 ratio
through off-site dedication of undisturbed and unencumbered coastal
sage habitat or payment of a mitigation in-lieu fee at the established
rate prior to th f a grading or clearing permit.
The mitigation habitat shall be located in the Mitigation Area to
enhance the long-term viability and function of the preserve system
in that any proposed off-site mitigation area is required
to be connected and contiguous to the natural habitat on adjacent
properties.

The mitigation will be to the long-term benefit of the Covered Species
and their habitats in that the dedication of a conservation easement
over undisturbed and connected coastal sage habitat will promote a
meaningful addition to the assembly of a viable regional system of
int J natural habitat habitat linkages, buffers
and wildlife corridors.

The mitigation shall foster the implementation of the
Poway Habitat C PI ~ective and efficient manner
in that any proposed off-site conservation area is required to be
connected to the natural habitat on the adjacent properties.
The mitigation will not .;lative fiscal impact with regard to
the implementation of the Poway Habitat Conservation
Plan.

The development will not have an adverse aesthetic, health, safety, or
architecturally related impact upon adjoining properties, because the roof
and the extedor building colors of the residence will be muted earthtones so
that the residence will blend with the surrounding natural :.

The City Council hereby approves Minor Development Review 98-35 subject to the
following conditions:
Within 30 days of approval the applicant shall submit in writing that all conditions of
approval have been read and understood.

Site shall be developed in accordance with the approved site plans on file in
the Planning Services Department and the conditions contained herein.
Revised site plans and building elevations incorporating all conditions of
approval shall be submitted to the Planning Services Department prior to
I building permits.
The applicant shall pay all applicable fees, including school fees, which are
presently $1.93 per square foot of assessable space (living area) prior to
building permit issuance. The fee amount shall be based on the rates in
effect at the time of building permit issuance.

$4,500 ( based on a 3,021 square foot residence).

time of building permit issuance.

The applicant shall comply with the latest adopted Uniform Building Code,
Uniform Mechanical Code, Uniform Plumbing Code, National Electric Code,
Uniform Fire Code, and all other applicable codes and ordinances in effect
at the time of building permit issuance.
Future grading of the hillside portions of the subject lot shall be prohibited
unless approved by the City Council.
All created or cleared slopes of 5:1 or greater shall be landscaped and
irrigated prior to final occupancy.
In the event the project ( including but not limited to the area to be graded
for the house pad, driveway, water tank placement any accessory
and the area proposed 1' for brush management) results in the
removal of coastal sage scrub, the developer has the option of either
utilizing the City of Poway's Federal and State permits through compliance
with the requirements of the Poway Subarea Habitat Conservation Plan or
the developer may apply directly to the U.S. Fish and Wildlife Service and
the California Department of Fish and Game for the required permits.
Should the developer choose to comply with the req ', : the Poway
Habitat Plan, prior to grading permit' letter shall be submitted to
the Planning Services Department advising of the decision for the project to
comply with the requirements of the Poway Habitat Plan.

The developer shall mitigate any removed coastal sage scrub at a 1:1
replacement ratio. In accordance with the Poway Habitat C Plan,
The mitigation can be accomplished in the form of off-site or on-site
dedication of a biological conservation easement of in kind habitat, or the
developer may pay a mitig fee at th ~lished at the time
of grading permit issuance. The mitigation requirement shall be completed
prior to ' I a grading or clearing permit.

The project grading plan shall show all on-site natural vegetation. Any
natural vegetation that will be impacted by the project ( including but not
limited to the area graded for the house pad, driveway, water tank placement
any accessory :l the area proposed for brush for fire
break) shall be noted on the grading plan to be removed.

The applicant shall submit a brush management plan to the Planning and
Safety Services Department 1 :t approval prior to grading permit
issuance.
17.
Prior to the start of the grading or clearing activity, stakes and tape shall be
installed to show the limits of grading and/or clearing for development
(including but not limited to the area graded for the house pad, driveway,
water tank placement, any accessory :l the area proposed for
brush for fire break). The Planning Services Department shall be
contacted to inspect the delineation of the limits of grading prior to the start
of grading or clearing activity.
18.
The proposed location of the required water tank for fire fighting shall be
reviewed and approved by the Planning Services Department prior to
installation. The color of the tank shall be earthtone and shall blend with the
surrounding natural :. Landscaping shall be installed around the
tank to screen it from view f :ling property.
19.
Any excess fill material from the project grading shall be used to regrade and
the existing lower pad to try and make the area app to
the original topography. A coastal sage scrub hydroseed mix shall be
applied to said area. This condition shall be accomplished prior to approval
for final occupancy of the residence.
20.
This approval shall become null and void if building p not issued
for this project within two years from the date of project approval.

This dwelling is being built on a parcel size of 1.91 acres and is 60 feet
beyond the distance from the nearest fire hydrant. The dwelling
will have to have standby water for firefighting and a residential sprinkler

GRADING
A grading plan for the development of the property shall be submitted to the
City's Engineering Services Department for th :t approval prior to
= a grading permit and start of grading operation unless grading
~hwork =less than 50 cubic yards. The grading plan
shall be prepared on a 24" x 36" standard sheet of mylar at a scale of 1" =
20' or larger by a registered civil engineer. Rough grading of the site must
be completed and shall meet the City's Engineering Services inspector's
approval prior 1 = a building permit. If no grading is required, a
certification from a State Registered Civil Engineer indicating the amount of
earthwork shall be furnished to said City's Engineering Services Department
and a $500 inspection fee shall be paid prior to building permit issuance.
Grading of the subject property shall be in accordance with the Uniform
Building Code, City Grading Ordinance, approved grading plan and
geotechnical report, and accepted grading practices.
A right-of-way permit shall be obtained from the City's Engineering Services
Department for any work to be done within the public street right-of-way or
any City held easement. Said work shall include, but is not limited to,
construction of driveway approach, sewer lateral installation, war
line installation, and street construction.
The following development fees shall be paid to the Engineering Services
Department prior to building permit issuance. These fees are currently in
effect and are subject to change.

The following fees shall be paid :y bond posted prior to issuance
of a building permit. If a security bond is posted, payment of the fees shall
be made prior I : a Certificate of Occupancy. Once payment is
received in full said security bond could be released to the applicant.

Erosion control, including but not limited to desiltation basins, shall be
installed and maintained from Oct. 15th to April 15th. A Irol plan
shall be prepared by the project civil engineer and shall be submitted as part
of the grading plan.
All proposed and existing utilities within the project shall be installed
underground.

sp provided in Section 17.08.17D of the Poway Municipal Code.
The minimum structural section shall be shown on the grading plan.
Completion of the driveway must be accomplished prior to issuance of a

be included in the cost estimate for plan check and determination of
inspection fees.

of California to perform such work. Copies of the report shall be submitted
with the grading plan.

A final compaction report and a certification of line and grade, prepared by
the project civil engineer shall be submitted upon completion of site grading.

Ordinance No 250, City Code Section 12.0.060

scheme and a local feeder trail is shown to cross the lot. The trail shall be
improved to City Standards ( improvements include signs, brow ditches,
erosion control bars, bridges, etc.).
