A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
APPROVING MINOR DEVELOPMENT REVIEW 98-71
ASSESSORS PARCEL NUMBER 277-080-12
WHEREAS Minor Development Review 98-71 (Hillside/Ridgeline), was submitted
by James Kennedy, Applicant, for the purpose of constructing a 3,706 square foot, two-
story residence on a 32.68 acre property located at 14755 Buds Lane in the Rural
Residential A zone; and
WHEREAS, on November 10, 1998, the City Council held a hearing to solicit
comments from the neighboring property owners, both pro and con, relative to this
application.
NOW, THEREFORE, the City Council does hereby
follows:
The City Council hereby finds that the project is exempt under the p ' ' I the

The property falls within the Poway Subarea Habitat Conservation Plan preserve
area. Mitigation for the removal of coastal sage scrub and/or chaparral plant

architecturally related impact upon adjoining properties, because the house
has been designed so that it is architecturally compatible with the
development on the hillside and surrounding rural residential properties.

The City Council hereby approves Minor Development Review 98-71 subject to the
following conditions:

approval have been read and understood.
COMPLIANCE WITH THE FOLLOWING CONDITIONS IS REQUIRED. COMPLIANCE
SHALL BE APPROVED BY THE DEPARTMENT OF PLANNING SERVICES.
Site shall be developed in accordance with the approved site plans on file in
the Planning Services Department and the condif :1 herein.
Revised site plans and building incorporating all conditions of
approval shall be submitted to the Planning Services Department prior to
; building permits.
The applicant shall pay all applicable fees, including school fees, which are
presently $1.93 per square foot of assessable space (living area) prior to
building permit issuance. The fee amount shall be based on the rates in
effect at the time of building permit issuance.
Prior to grading permit issuance, the applicant shall provide d
showing that a biological ~, required with MDRA 98-71
for compensation for the loss of any undisturbed areas of coastal sage scrub
and/or chaparral habitat is recorded on the subject property.
The developer shall pay an Affordable Housing In-Lieu Fee in the amount of
$4,500 ( based on a 3,706 square foot residence).

The driveway shall be designed and installed in compliance with Section
17.08.170D of the Poway Municipal Code.
Approval of this request shall not 31iance with all sections of the
Zoning Ordinance and all other applicable City Ordinances in effect at the
time of building permit issuance.

The applicant shall comply with the latest adopted Uniform Building Code,
Uniform Mechanical Code, Uniform Plumbing Code, National Electric Code,

unless approved by the City Council.

irrigated prior to final occupancy.

reviewed and approved by the Planning Services Department prior to

COMPLIANCE WITH THE FOLLOWING CONDITIONS IS REQUIRED. COMPLIANCE
SHALL BE APPROVED BY THE DEPARTMENT OF SAFETY SERVICES.
Roof covering shall meet Class A fire retardant testing as specified in the
Uniform Building Standards No. 32-7 for fire retardant roof covering
materials, per City of Poway Ordinance #64.
Approved numbers or addresses shall be placed on the building in such a
position as to be plainly visible and legible from the street fronting the

The access roadway shall be extended to within 150' of all portions of the
exterior walls of the first story of any building. Where the access roadway
cannot be provided, approved fire protection system(s) shall be provided as
required and approved by the Chief.
A residential fire sprinkler system with a one-inch meter will be required.
Plans shall be submitted to the Fire Prevention Bureau for approval prior to
installation. (If a one-inch lateral off the street main is currently not present,
one will have to be installed.)
Provide a 10,000 gallon water tank with a 4 inch riser, equipped with a 2 ~
inch national standard discharge within 50 feet of the residence and

A grading plan for the development of the property shall be submitted to the
City's Engineering Services Department for review and approval prior to
: a grading permit and start of grading operation. The grading plan
shall be prepared on a standard sheet of Mylar at a scale of 1"=20' or larger
by a registered civil engineer. Rough grading of the site must be completed
and shall meet the City's Engineer Services inspector's approval prior to
:a building permit. Grading plan shall include intersection detail of
proposed of proposed private road with existing pavement.
A drainage system capable of handling and disposing all surface water
originating within the project, and all surface waters that may flow onto the
project from adjacent lands, shall be required. Said drainage system shall
include any ' and as required by the Director of
Engineering Services to properly handle the drainage.
A right-of-way permit shall be obtained from the City's Engineering Services
Department for any work to be done within the public street right-of-way or any
City-held easement. Said work shall include, but is not limited to,

Road Standards per Ordinance No. 280. Its completion thereof shall be done

comply with Ordinance No. 280, City Code Section 12.20.060.
Leach field layout or seepage pit layout for the residence sewage disposal
system shall be submitted to the City's Engineering Services Department for
:1 approval by the City Engineer prior to obtaining a septic system

County of San Diego Health. If a
septic system installation permit had been obtained without a City approved
layout, one shall be submitted prior to installation of leach lines.
