A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
AWARDING BIDS TO VARIOUS BIDDERS
FOR FOUR OF FIVE CHEMICALS FOR
WATER TREATMENT; FINDING NO BIDS
FOR THE SUPPLY OF LIQUID PERMANGANATE
AND DIRECTING OPEN MARKET PURCHASE
OF LIQUID PERMANGANATE
WHEREAS, the City of Poway did duly advertise for bids for the purchase of five
(5) different chemicals used in treating the municipal water supply; and
WHEREAS, the time set for the deadline to receive bids for the purchase of the
chemicals for treating the water supply was 3:00 p.m. on April 16, 2015; and
WHEREAS, responsive bids were received for four of the five chemicals; and
WHEREAS, the chemical liquid permanganate did not receive a responsive bid;
and
WHEREAS, Poway Municipal Code Section 3.28.070 (E) provides that in the
purchase of supplies in excess of $50,000, the City Council may reject all bids and
readvertise for bids or, if no bids were received, the City Council may follow the
procedures set forth in Public Contract Code Section 20167 and direct the Director of
Administrative Services, or a person designated by the Director of Administrative
Services to proceed with procedures for purchase of the supplies through the open
market process; and
WHEREAS, Purchasing, in concurrence with the Director of Administrative
Services, recommends that the City Council finds that no responsive bids for the
provision of liquid permanganate were received and thereafter direct the Director of
Administrative Services or a person designated by the Director of Administrative
Services to proceed to acquire the chemical through open market purchasing; and
WHEREAS, the City Council believes it to be in the best interest of the City to
proceed with the purchase of the four chemicals that received a responsive bid and
award the individual contracts through the award of bid process; further it is the belief of
the City Council that the purchase of the liquid permanganate is best achieved through
open market purchasing.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway
as follows:
Section 1: Award the following companies the designated portions of the bids
by chemical and at the corresponding price as follows: Thatcher Company of California,
Inc., (liquid alum), $58,996.80; JCI Jones Chemicals, Inc., (liquid chlorine), $47,478.00;

Brenntag Pacific, Inc., (sodium hydroxide), $63,495.68; and Hill Brothers Chemical
Company, (aqua ammonia), $17,920.00.
Section 2: The City Council hereby finds that after fully complying with the
City's purchasing ordinance, no responsive bids were received for liquid permanganate.
Section 3: The City Council hereby determines that because no bids were
received for providing liquid permanganate, purchase of the product can be better
achieved through open market purchasing, and the City Council directs the Director of
Administrative Services or a person designated by the Director of Administrative
Services to proceed to acquire the chemical through open market purchasing.
PASSED, ADOPTED AND APPROVED by the City Council of the City of
Poway at a regular meeting this 16th day of June 2015.
