A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
APPROVING TENTATIVE TRACT MAP 97-01
ASSESSOR'S PARCEL NUMBER 317-280-62
WHEREAS, Tentative Tract Map No. 97-01, hereinafter referred to as "Map,"
submitted by Tech Business Center, LLC, a Limited Liability Corporation, applicant,
for the purpose of subdividing the real property situated in the City of Poway,
County of San Diego, State of California, described as the southeast quarter of the
southeast quarter of Section 24, Township 14 south, Range 2 west, all in the San
Bernardino Meridian into 14 lots, regularly came before the City Council on
November 10, 1998; and
WHEREAS, the Director of Planning Services h :led approval
of the map subject to all conditions set forth in the Planning Services Department
report; and
WHEREAS, the City Council has read and considered said report and has
considered other evidence presented at the public hearing.
WHEREAS, pursuant to G : Code Section 66020(d)(1), NOTICE IS
FURTHER GIVEN that the 90-day period to protest the imposition of any fee,
ded or otb described in this resolution begins on the
effective date of this resolution and any such protest must be in a manner that
complies with Section 66020.
NOW, THEREFORE, the City Council does hereby
follows:
The previously certified Final E Impact Report (FEIR) for the
South Poway Specific Plan and the Subsequent E Iai Impact
Report (SEIR) of July 26, 1988 have been considered and found to be
adequate for this tentative tract map in that the map is conditioned to
conform to the adopted South Poway Planned Community.
The City Council makes the following findings regarding Tentative Tract Map
97-01 and the Map thereof:

The tentative tract map' l with the Comprehensive Plan of
the City of Poway and the specific plan for the South Poway Planned
Community.
The design or improvement of the tentative tract map is consistent
with all applicable general and specific plans; in that the design is
conditioned t the limits of grading and the imp
adhere to the development standards of the planned community.
The site is physically suitable for the type of development proposed;
in that the development plans will incorporate contour grading,
minimum grading methods, and building siting and landscaping to
soften slopes.
The site is physically suitable for the density of the development
proposed. The net buildable areas will adhere to the acreage
allocated in the adopted planned community.
The design of the subdivision is not likely to cause substantial
damage and avoidable injury to h :t wildlife or
their habitat; in that these factors were considered in the
E Impact Report (EIR) as well as the Subsequent EIR
(SEIR) and findings made in July 1985 for the planned community
and the project includes open space lots on south facing slopes.
The tentative tract map is not likely to cause serious public health
problems; in that all lots will be served by publ :t sanitary
sewer service and be subject to County regulations ~

The design of the tentative tract map will not conflict with any
easement by the public at large, now of record, for access through or
use of the property within the proposed subdivision.

Within 30 days of approval the applicant shall submit in writing that all
conditions of approval have been read and understood.

Subsequent EIR for the South Poway Planned Community for which the City

machinery producing noise levels.

authority in the field of acoustics may be required to submit evidence in

standards will be satisfied:

Grading of the subject property shall be in accordance with the Uniform
Building Code, City Grading Ordinance, South Poway Specific Plan (Volume
2/Development Standards), approved grading plan and geotechnical report,
and accepted grading practices.
A soils/geological report shall be prepared by a qualified engineer licensed
by the State of California to perform such work.
The final grading plan, prepared on a standard sheet of mylar, shall be
subject to review and approval by the Planning and Engineering Services
Departments and shall be completed prior t I a grading permit.
A pre-blast survey of the surrounding property shall be conducted to the

of the National Pollutant Discharge Elimination System (NPDES) permit. An

Install street lights along the south side of Scripps Poway Parkway and the
east side of Tech Center Drive fronting the subdivision. Lights shall be 180-

Light spacing at Scripps Poway Parkway shall be 600 feet on center on
south side of the road and at Tech Center Drive at 300 feet on center at
alternating side of the road. However, if th 3 lights on the north
side of Scripps Poway Parkway, the placement of lights on the south side
shall be at midpoint between the existing lights. These spacings may be
modified with the approval of the Director of Engineering Services.
Improve Gregg Street to C Street Standards as set forth in
Chapter 2, Section 1E of the South Poway Specific Plan/Development Plan,
dated November 1995. Improvement shall include, but is not limited to,
street paving at a width of 48 feet curb to curb, = )
and sidewalk, street lighting, and appropriate signage.
Improve Kirkham Way, from Tech Center Drive to a point opposite the
easterly subdivision boundary, to the standards for C /Industrial
Collectors (without median) as set forth in Chapter 2, Section 1C of the
South Poway Specific Plan/Development Plan, dated November 1995.
Improvement shall include, but is not limited to, street paving at a width of 64
feet curb to curb, ~ and sidewalk, street lighting,
and appropriate signage. The profile and alignment shall conform to the
proposed or approved tentative map on adjacent property, if applicable.

Scripps Poway Parkway, 49 feet for Tech Center Drive and Gregg Street,
and 65 feet for Kirkham Way.
All street structural sections shall be submitted to and approved by the
Director of Engineering Services prior to construction.
Street improvements shall comply with City of Poway standards and

originating within the project, and all surface waters that may flow onto the
project from adjacent lands, shall be required. The drainage system shall
include a drainage study, easement dedications, storm drains,
