P- g8-65 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA APPROVING TENTATIVE TRACT MAP 97-01 ASSESSOR'S PARCEL NUMBER 317-280-62 WHEREAS, Tentative Tract Map No. 97-01, hereinafter referred to as "Map," submitted by Tech Business Center, LLC, a Limited Liability Corporation, applicant, for the purpose of subdividing the real property situated in the City of Poway, County of San Diego, State of California, described as the southeast quarter of the southeast quarter of Section 24, Township 14 south, Range 2 west, all in the San Bernardino Meridian into 14 lots, regularly came before the City Council on November 10, 1998; and WHEREAS, the Director of Planning Services h :led approval of the map subject to all conditions set forth in the Planning Services Department report; and WHEREAS, the City Council has read and considered said report and has considered other evidence presented at the public hearing. WHEREAS, pursuant to G : Code Section 66020(d)(1), NOTICE IS FURTHER GIVEN that the 90-day period to protest the imposition of any fee, ded or otb described in this resolution begins on the effective date of this resolution and any such protest must be in a manner that complies with Section 66020. NOW, THEREFORE, the City Council does hereby follows: The previously certified Final E Impact Report (FEIR) for the South Poway Specific Plan and the Subsequent E Iai Impact Report (SEIR) of July 26, 1988 have been considered and found to be adequate for this tentative tract map in that the map is conditioned to conform to the adopted South Poway Planned Community. The City Council makes the following findings regarding Tentative Tract Map 97-01 and the Map thereof: Resolution No. P- 98-65 Page 2 The tentative tract map' l with the Comprehensive Plan of the City of Poway and the specific plan for the South Poway Planned Community. The design or improvement of the tentative tract map is consistent with all applicable general and specific plans; in that the design is conditioned t the limits of grading and the imp adhere to the development standards of the planned community. The site is physically suitable for the type of development proposed; in that the development plans will incorporate contour grading, minimum grading methods, and building siting and landscaping to soften slopes. The site is physically suitable for the density of the development proposed. The net buildable areas will adhere to the acreage allocated in the adopted planned community. The design of the subdivision is not likely to cause substantial damage and avoidable injury to h :t wildlife or their habitat; in that these factors were considered in the E Impact Report (EIR) as well as the Subsequent EIR (SEIR) and findings made in July 1985 for the planned community and the project includes open space lots on south facing slopes. The tentative tract map is not likely to cause serious public health problems; in that all lots will be served by publ :t sanitary sewer service and be subject to County regulations ~ hazardous materials. The design of the tentative tract map will not conflict with any easement by the public at large, now of record, for access through or use of the property within the proposed subdivision. ~ecision: Tentative Tract Map No. 97-01, on file in the Planning Services office, is hereby approved subject to all of the following conditions: COMPLIANCE WITH THE FOLLOWING CONDITIONS IS REQUIRED. Site shall be developed in accordance with the approved site plans on file in the Planning Services Department and the conditions contained herein. Approval of this request shall not 31lance with all sections of the South Poway Specific Plan, Zoning Ord' :1 all other applicable City Ord' :l:ect at the time of building permit issuance. Street trees, a minimum of 15 gallon size or larger, shall be installed in accordance with the City of Poway Guide to Landscape Requirements and shall be planted at an average of 30 feet on center spacing along all streets. Slopes shall be planted with trees, hydroseed, or other plant :hin six months of completion of final grading to establish screening landscaping. Use of recycled water will be required for on-site landscape irrigation. Any expansion of industrial or use on this property will require an amendment to the SPPC Development Plan and its associated Iai impact report. It shall also be stipulated that the City has the right to review and modify the level of maintenance. Access control methods such as signage, fencing, and other forms of barriers should be utilized within natural open space or rural residential areas, in order to minimize habitat disruption. INFORMATIONAL CONDITIONS Industries shall provide noise attenuation devices for equipment of machinery producing noise levels. Prior to granting occupancy for any buildings, an accredited expert or authority in the field of acoustics may be required to submit evidence in accordance with the following procedures which certifies that local noise standards will be satisfied: An acoustical analysis report describing in detail the exterior noise l and th design features required to achieve the interior noise standards shall be submitted to the Director of Planning Services for approval. Prior to granting occupancy, satisfactory evidence shall be submitted to the Director of Planning Services, which indicates that the sound attenuation specified in the approved report have been incorporated into the design of the project. 3. Siting of landscaping, parking lots, and walkways shall be designed to maximize pedestrian and auto safety. Energy-efficient structures should be constructed utilizing both building design and siting, and landscaping design such as: a. Taking advantage of heating/cooling by sun/wind exposure. b. Utilizing energy-efficient lighting systems. heating systems as feasible or constructing buildings to allow easy installation of such systems later. Project architects and planners should comply with SDG&E :lations for applying energy conservation techniques. Full advantage should be taken of opportunities to utilize cogeneration or heat exchange systems within industrial land uses. Resolution No. P- 98-65 Page 8 Grading of the subject property shall be in accordance with the Uniform Building Code, City Grading Ordinance, South Poway Specific Plan (Volume 2/Development Standards), approved grading plan and geotechnical report, and accepted grading practices. A soils/geological report shall be prepared by a qualified engineer licensed by the State of California to perform such work. The final grading plan, prepared on a standard sheet of mylar, shall be subject to review and approval by the Planning and Engineering Services Departments and shall be completed prior t I a grading permit. A pre-blast survey of the surrounding property shall be conducted to the :the Director of Engineering Services prior to any rock blasting. ^ blasting permit shall be obtained from the Engineering Services Department pdor to any rock blasting. Seismic Recordings shall be taken for all blasting and blasting shall occur only at I -I levels approved by the Director of Engineering Services. All new slopes shall be a r2:1 (horizontal to vertical). A final soils compaction report shall be submitted and approved by the City's soils engineer prior 1 f building permits. A certification of line and grade, prepared by the project civil engineer, shall be submitted prior 1 I building permits. Buildings and parking lots shall be at least five feet from tops and toes of slopes, :1 by Planning and Engineering Services Departments prior to grading permit issuance. Non-supervised or non-engineered fill is specifically not allowed. Rock disposal areas shall be graded in compliance with City-approved soils investigations and :lations and grading plans. An NPDES permit shall be obtained from the State Water Quality Control Board and a copy provided to the City prior to start of grading operation. ~TS Install street lights along the south side of Scripps Poway Parkway and the east side of Tech Center Drive fronting the subdivision. Lights shall be 180- watt Iow pressure sodium type ' :1 at height of 30 feet. Light spacing at Scripps Poway Parkway shall be 600 feet on center on south side of the road and at Tech Center Drive at 300 feet on center at alternating side of the road. However, if th 3 lights on the north side of Scripps Poway Parkway, the placement of lights on the south side shall be at midpoint between the existing lights. These spacings may be modified with the approval of the Director of Engineering Services. Improve Gregg Street to C Street Standards as set forth in Chapter 2, Section 1E of the South Poway Specific Plan/Development Plan, dated November 1995. Improvement shall include, but is not limited to, street paving at a width of 48 feet curb to curb, = ) and sidewalk, street lighting, and appropriate signage. Improve Kirkham Way, from Tech Center Drive to a point opposite the easterly subdivision boundary, to the standards for C /Industrial Collectors (without median) as set forth in Chapter 2, Section 1C of the South Poway Specific Plan/Development Plan, dated November 1995. Improvement shall include, but is not limited to, street paving at a width of 64 feet curb to curb, ~ and sidewalk, street lighting, and appropriate signage. The profile and alignment shall conform to the proposed or approved tentative map on adjacent property, if applicable. Design and construct a traffic signal at the ' of Scripps Poway Parkway and Tech Center Drive to the of the Director of Engineering Services. Any offsite street rights of way shall be dedicated to the City by separate prior to final map approval. Rights-of-way width are 107 feet for Scripps Poway Parkway, 49 feet for Tech Center Drive and Gregg Street, and 65 feet for Kirkham Way. All street structural sections shall be submitted to and approved by the Director of Engineering Services prior to construction. Street improvements shall comply with City of Poway standards and specifications. Cost of analysis shall be paid by the applicant/developer at first submittal of improvement plans. Fire hydrants, per City of Poway specifications and standards, shall be installed at locations determined by the City Fire Marshal. All fire hydrants shall b :t by the City. SEWER IMPROVEMENTS A sewer system shall be designed and J to meet the req of the City of Poway and the County of San Diego Department of Health. The system shall include construction of offsite lines and appurtenances for to existing public sewer lines. If no exists in Kirkham Way east of Tech Center Drive prior to final map approval, a in Kirkham Way shall be extended from Tech Center Drive to the Eastedy subdivision boundary. Existing reimbursement agreements will be subject to modification if developer installs th' S 3ility, for a total of 78.1 EDU, has b ,1 per LOA # 223. Fifty percent of the sewer fees have been paid to date. The balance of the Resolution No. P- 98-65 Page 11 sewer fees shall be paid pdor to building permit issuance. The fee balance shall be increased accordingly if building area exceeds the allowable building area of each lot (based on 40 percent of the net usable area as shown on the lot area tabulation for this TM 97-01 ). DRAINAGE IMPROVEMENTS A drainage system capable of handling and disposing all surface water originating within the project, and all surface waters that may flow onto the project from adjacent lands, shall be required. The drainage system shall include a drainage study, easement dedications, storm drains, :Is, and detention basin as required by the Director of Engineering Services to properly handle the drainage. I ' drains shall be required at locations specified by the Director of Engineering Services and in accordance with standard engineering practices. These fees are subject to an additional five (5) percent interest charge compounded annually from December 1, 1997 to time of payment. A. The applicant/developer shall pay to the City, prior to final map approval, the sum of $304,450.24 as its pre rata share for the construction of Scripps Poway Parkway abutting their project. 1. The final map shall conform to City standards and procedures, City subdivision ordinance, Subdivision Map Act, and Land Surveyors Act. 2. All easements and/or right-of-way dedications to the City that is/are within the limits of a subdivision shall be made on the final map. All offsite easement dedications, by a separat :(s) other than a map, shall be recorded prior to final map approval. A processing fee shall be paid to the City for all easements and/or right-of- way dedications made through a separate instrument(s) other than a map. 3. A ·Iion bond in l acceptable to the City Engineer shall be posted prior to final map approval. 4. Developer and Poway Redevelopment Agency or City shall execute an owner participation agreement(between Developer and the Agency), development agreement, and/or reimbursement agreement(between Developer and the City) which results in the financing and construction of the required imp 5.
