A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
APPROVING MINOR DEVELOPMENT REVIEW 98-61
ASSESSORS PARCEL NUMBER 278-210-31
WHEREAS Minor Development Review 98-61 (Hillside/Ridgeline), was submitted
by Jim Hyslop and Anne O'Dell, Applicants, for the purpose of ' ;] a 2,250 square
foot, single story resid 18.85 acre property located at 15450 Highway 67 in the
Rural Residential A zone; and
WHEREAS, on January 26, 1999, the City Council held a hearing to solicit
~ from the neighboring property owners, both pro and con, relative to this
application; and
WHEREAS, pursuant to G ~ Code Section 66020(d)(1), NOTICE IS
FURTHER GIVEN that the 90-day period to protest the imposition of any fee, dedication,
reservation, or otb described in this resolution begins on the effective date of
this resolution and any such protest must I: that complies With Section 66020.
NOW, THEREFORE, the City Council does hereby
follows:
The City Council hereby finds that the project is exempt under the p ' ' : the
Califomia E ~ ~ Quality Act, Class 3, in that it is th ; a single
family home.
The property is located within the Poway Subarea Habitat Conservation Plan
Mitig ' The house and all other imp to be located within an
existing wholly disturbed area of the property adjacent to State Highway 67. No
loss of habitat or other adverse affects to wildlife will occur as a result of the
development of this home.
The development will not have an adverse aesthetic, health, safety, or
architecturally related impact upon adjoining properties, because the house
has been designed so that it is architecturally compatible with the
development on the hillside and surrounding residential properties.
The dev~l(~pment encourages the orderly and h appearance of

The City Council hereby approves Minor Development Review 98-61 subject to the
following conditions:
Within 30 days of approval the applicant shall submit in writing that all conditions of
approval have been read and understood.
COMPLIANCE WITH THE FOLLOWING CONDITIONS IS REQUIRED. COMPLIANCE
SHALL BE APPROVED BY THE DEPARTMENT OF PLANNING SERVICES.
Site shall be developed in accordance with the approved site plans on file in
the Planning Services Department and the conditions contained herein.
Revised site plans and building elevations incorporating all conditions of
approval shall be submitted to the Planning Services Department prior to
I building permits,
The applicant shall pay all applicable fees, including school fees, which are
presently $1.93 per square foot of assessable space (living area) prior to
building permit issuance. The fee amount shall be based on the rates in
effect at the time of building permit issuance.
The developer shall pay an Affordable Housing In-Lieu Fee in the amount of
$4,350 ( based on a 2,850 square foot residence).
The driveway shall be designed and installed in compliance with Section
17.08.170D of the Poway Municipal Code.
Approval of this request shall not 31iance with all sections of the
the Zoning Ordinance and all other applicable City Ord fect at the
time of building permit issuance.

The applicant shall comply with the latest adopted Uniform Building Code,
Uniform Mechanical Code, Uniform Plumbing Code, National Electric Code,

at the time of building permit issuance.

Future grading of the hillside portions of the subject lot shall be prohibited
unless approved by the City Council.

irrigated prior to final occupancy.

The proposed location of a required water tank for fire fighting shall be
reviewed and approved by the Planning Services Department prior to

This approval shall become null and void if building permits are not issued
for this project within two years from the date of project approval.

Uniform Building Standards No. 32-7 for fire retardant roof covering
materials, per City of Poway Ordinance #64.

The access roadway shall be extended to within 150' of all portions of the
exterior walls of the first story of any building. Where the access roadway
cannot be provided, approved fire p /stem(s) shall be provided as
required and approved by the Chief.
This dwelling is being built on a parcel size of 18.85 acres and is beyond 500
feet maximum from the nearest fire hydrant. The dwelling will have to have
standby water for firefighting and a residential sprinkler system. Contact the
Fire Prevention Bureau for details.
Provide a 10,000 water tank with a 4" underground supply line to a 2 %"
(National Standard) thread discharge within 50 feet of the main house and
accessible to the fire truck. Contact Inspector Walter at 679-4338 to
establish this location.
COMPLIANCE WITH THE FOLLOWING CONDITIONS IS REQUIRED. COMPLIANCE
SHALL BE APPROVED BY THE DEPARTMENT OF ENGINEERING SERVICES.
Grading of the subject property shall be in accordance with the Uniform
Building Code, City Grading Ordinance, approved grading plan and
geotechnical report, and accepted grading practices.
A grading plan for the development of the property shall be submitted to the
City's Engineering Services Department for review and approval prior to
~ a grading permit and start of grading operation unless grading
involves earthwork '~ of less than 50 cubic yards. If no grading is
required, a certificate from a State Registered Civil Engineer indicating the
amount of earthwork shall be furnished to said City's Engineering Services
Department and a $500 inspection fee shall be paid prior to building permits
issuance. The grading plan if required shall be drawn to a scale of 1" = 20'
or larger on a City of Poway standard 24"x 36" mylar drawing.

A soils report shall be prepared by a qualified Engineer licensed by the State
of California to perform such work. Copies of the report shall be submitted
with the grading plan.
All new slopes shall

A final compaction report and a certification of line and grade, prepared by
the project civil engineer shall be submitted upon completion of site grading.
Erosion control, including but not limited to desiltation basins, shall be

of the grading plan. The developer shall make provisions to insure the

The construction of driveway to comply with the standards and specifications
provided in section 17.08.170D of the Poway Municipal Code. Th ' '
structural section shall be shown on the grading plan. Completion of the
driveway must be accomplished prior to issuance of a Certificate of
Occupancy. C inspection shall be performed by the Engineering
Department inspectors. The driveway construction cost shall be included
in the cost estimate for plan checking and determination of inspection fees.
A right-of-way permit shall be obtain from the City's Engineering Services
Department for any work to be done within the public street right-of-way or
any City-held easement. Said work shall include, but is not limited to,
construction of driveway approach, sewer lateral installation,
line installation, and street construction.
A right-of-way permit shall be obtained from California Department Of
Transportation for any work to be done within Highway 67 right-of-way or any
Caltrans-held easement.

The following fees shall be paid .7 bond posted prior to issuance
of a building permit. If a security bond is posted, payment of the fees shall
be made prior 1 of a Certificate of Occupancy. Once payment
is received in full said security bond could be released to the applicant.

COMPLIANCE WITH THE FOLLOWING CONDITIONS IS REQUIRED. COMPLIANCE
SHALL BE APPROVED BY THE DEPARTMENT OF PUBLIC SERVICES.
A 15-foot-wide trail shall be dedicated and constructed along the north side of the
right-of-way of State Highway 67 per the adopted City of Poway Trail standards.
