Res P-99-15RESOLUTION NO. P-99-15 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA APPROVING MODIFICATION OF CONDITIONAL USE PERMIT 89-10 ASSESSOR'S PARCEL NUMBER 314-202-16 WHEREAS, Modification of Conditional Use Permit 89-10 submitted by the City of Poway, Applicant, request to construct a 26-foot diameter train turntable, a small tool house and static display area and the relocation of the Caboose and Boxcar trash :hin the Old Poway Park; and WHEREAS, of February 16, 1999 the City Council held a duly noticed hearing to solicit comments from the public on the above referenced item. NOW, THEREFORE, the City Council does hereby follows: The City Council finds that the previously issued Negative Declaration adequately discusses th Iai : this project. SE The proposed project is consistent with the General Plan in that the proposed 'y and working components of the existing h' for which the park is designed. The proposed project will not have an ad :hetic, health, safety or architecturally related impacts upon adjoining properties, in that the design and relocation of th keeping with the architectural guidelines for the park and will be compatible with nearby buildings and :hin the Old Poway Park. The proposed project is in compliance with the Zoning Ordinance, in that it complies with the development standards adopted for the Old Poway Park. The proposed project encourages the orderly and h 3pearance of :1 property with the City, th appearance has been designed in an architectural style which is sympathetic to the adjoining train barn. Resolution No. p. 99-J. 5 Page 2 The g 'traffic will not adversely impact the capacity and physical character of the surrounding streets in that the proposed improvement are intended primarily to support the train and associated equipment. There are public t' :1 utilities available to service the project. There will not be significant harmful effects upon th in that the improvement will take place within existing disturbed areas that are presently unvegetated. The City Council hereby approves the Modification to CUP 89-10 subject to the following conditions: The use conditionally granted by this permit shall not be conducted in such a manner as to interfere with the reasonable use and enjoyment of surrounding residential and ' ' uses. This conditional use permit shall be subject to annual review by the Director of Planning Services for compliance with the conditions of approval and to address concerns that may have occurred during the past year. If the permit is not in compliance with the conditions of approval, or the Planning Services Department h :1 complaints, the required annual review shall be set for a public hearing before the City Council, to consider modification ~ the use permit. COMPLIANCE WITH THE FOLLOWING CONDITIONS IS REQUIRED. COMPLIANCE SHALL BE APPROVED BY THE DEPARTMENT OF PLANNING SERVICES. SITE DEVELOPMENT Site shall be developed in accordance with the approved site plans on file in the Planning Services Department and the conditions contained herein. LANDSCAPE IMPROVEMENTS A landscape plan shall be submitted to and approved by the Planning Services Department prior to the ' ! building permits. Plans shall be prepared in accordance with City of Poway Guide to Landscape Requirements (latest edition). Existing on-site trees shall be retained wherever possible and shall be maintained in a horticulturally acceptable manner. Dead, decaying, or potentially dangerous trees shall be approved for removal at the discretion of the Planning Services Department during the review of the Master Plan of existing on-site trees. Living trees which are approved 1' shall be replaced on a t r basis as required by the Planning Services Department. All landscaped areas shall be J in a healthy and thriving condition, free from weeds, trash, and debris. The trees shall I; ;]ed and allowed to retain a natural form. SIGNS Any signs proposed for this development shall be designed and approved in :h the Sign Ordinance. GRADING Grading of the subject property shall be in accordance with the Uniform Building Code, City Grading Ordinance, approved grading plan and geotechnical report, and accepted grading practices. STREETS AND SIDEWALKS All damaged off-site public works facilities, including sidewalks, wood planking and trees, shall be repaired or replaced prior1 :bonds and imf to the sat : the Department of Engineering Services. Resolution No. P- 9 9-15 Page 4 Prior to any work being performed in the public right-of-way, an encroachment permit shall be obtained from the Engineering Services department and appropriate fees paid, in addition to any other permits required. UTILITIES 1. All proposed utilities within the project shall be installed underground.
