P- 99-17 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA APPROVING TENTATIVE PARCEL MAP 98-14 ASSESSOR'S PARCEL NUMBER APN: 321-111-02; 322-011-03 WHEREAS, Tentative Parcel Map 98-14, hereinafter referred to as "Map", submitted by Zip Lucidi, Applicant, for the purpose of subdividing the real property situated in the City of Poway, County of San Diego, State of California, described as a portion of the west half of Section 3 and the south half of Section 4, Township 14 South, Range 1 West, San Bemardino Base and Meridian, City of Poway, County of San Diego. The 190 acre parcel is proposed to be subdivided into four parcels of 20 to 80 acres in size and a remainder parcel of 30 acres on the northwest corner of Highway 67 and Poway Road within the Rural Residential a zone. Access to the westerly parcel would be from Mina de Oro Road extending north from Poway Road. WHEREAS, on March 2, 1999 the City Council held a hearing on the above- referenced item. WHEREAS, pursuant to G :Code Section 66020 (d)(1) , NOTICE IS FURTHER GIVEN that the 90-day period to protest the imposition of any fee, dedication, reservation, or otb described in this resolution begins on the effective date of this resolution and any such protest must b that complies with Section 66020. NOW, THEREFORE, the City Council does hereby follows: The City Council hereby issues a Negative Declaration with Mitigation Measures (indicating no significant adverse Iai impacts anticipated due to the addition of special req ' to the project). The property falls within the Poway Subarea Habitat Conservation Plan (PSHCP) preserve area. Mitigation for the removal of coastal sage scrub and/or chaparral plant communities is required prior to the ' : a grading permit. 1. The mitigation ' the PSHCP; with and furthers the implementing objective of The mitigation habitat is appropriately located ' :1 therefore will enhance the long-term viability and function of the preserve system; The mitigation will be to the long-term benefit of the covered species and their habitats in that it preserves then northerly and westerly portions of the property which are undisturbed habitat with revegetation of adjacent graded slopes with native plant species; _ Resolution No. P-99-17 Page 2 The mitigation will foster the incremental implementation of the HCP in an effective and efficient manner; and, The mitigation will not result in a negative fiscal impact with regard to the imp1 ~ the PSHCP. o = The approved project is consistent with the General Plan in that the site is zoned RR-A with a General Plan designation of Rural Residential ^. The design and improvements required of the tentative parcel map are consistent with all applicable general and specific plans; in that the approved pamel sizes and config :lhere to the development standards for the RR-A zone. The site is physically suitable for the type of development and the density proposed; in that the overall slope of the property is in the 15-20 percent range which is within the City of Poway standards for parcel maps and the site is located with' ~ predominantly rural residential development. The design of the subd' ' ' : likely I 3stantial damage and avoidable injury to h :1 wildlife or other habitat in that the majority of the site has been previously disturbed by agricultural development and the conditions of approval assure that any impacts ,I with the proposed development will be mitigated. The tentative parcel map is not likely I public health problems in that wells are available to the property and the County E Iai Health Division has found the p ~)le for septic systems. The design of the tentative parcel map will not conflict with any easement by the public at large, now of record, 1' through or use of the property within the proposed subdivision. The City Council hereby approves Tentative Parcel Map 98-14 subject to the following conditions: Within 30 days of approval, the applicant shall submit in writing that all conditions of approval have been read and understood. Resolution No. P-99-17 Page 3 COMPLIANCE WITH THE FOLLOWING CONDITIONS IS REQUIRED. COMPLIANCE SHALL BE APPROVED BY THE DEPARTMENT OF PLANNING SERVICES. Any native tree or shrub removal shall occur between the months of September and February to avoid any potential impacts to nesting birds and to comply with the federal Migratory Bird Treaty Act. Springtime biological surveys shall be conducted for the pamels prior to approval of minor development reviews for single-family homes on each parcel. Dedicate open space on each parcel to offset habitat impacts by either a fee title transfer to the City of Poway or by recording biological conservation easements on each parcel prior to ' I grading permits on each parcel. 10. Resolution No. P-99-17 Page 4 Coordinate development of the parcels with the Planning and Engineering Services Departments for the detention basin study and any areas of the parcels that may be subject to future inundat' A Phase 1 Quino Checkerspot Butterfly survey is required in Spring 1999 along with an updated gnatcatcher survey for all areas of the four parcels and remainder subject to development that have not been previously cleared of native vegetation. Complete an archaeological background study of Parcel 1 to determine the p ~sence of prehistoric cultural If found, site records shall be completed and filed, and a testing plan implemented. Update the January 1997 archaeological background study and field check, as necessary, for Parcels 2,3,4 and the remainder. Comply with th graded area, slope requirements and pad elevations of the Poway General Plan and Zoning Ordinance. The approval of this tentative parcel map shall expire at the end of two years if either a parcel map has not been approved and recorded or a time extension has not been sought by February 23, 2001. A Minor Development Review shall be accomplished prior to the issuance of a building permit on the new parcel. COMPLIANCE WITH THE FOLLOWING CONDITIONS IS REQUIRED. COMPLIANCE SHALL BE APPROVED BY THE DEPARTMENT OF ENGINEERING SERVICES. GRADING Grading of the subject property shall be in accordance with the Uniform Building Code, City Grading Ordinance, approved grading plan and geotechnical report, and accepted grading practices. A grading plan for the development of the property, prepared on a standard sheet of mylar and drawn at a scale of 1" = 20, shall be submitted to the City's Engineering Services Department for review and approval prior to issuance of a grading permit and start of grading operation. Resolution No. P-99-17 Page 5 A pre-blast survey of the surrounding property shall be conducted to the satisfaction of the City Engineer prior to any rock blasting. A blasting permit shall be obtained from the Engineer Services Department prior to any rock blasting. Seismic recordings shall be taken for all blasting and blasting shall occur only at locations and levels approved by the City Engineer. Non-supervised or non-engineered fill is specially not allowed. Rock disposal areas shall be graded in compliance with City-approved :igations and :lations and grading plans. Intersection drains shall be required at locations specified by the Director of Engineering S :t in accordance with standard engineering practices. A drainage system capable of handling and disposing all surface water originating within the project, and all surface waters that may flow onto the project from adjacent lands, shall be required. Said drainage system shall include any easements and :luired by the Director of Engineering Services to properly handle the drainage. A soils report shall be prepared by a qualified engineer licensed by the State of California to perform such work. Copies of the report shall be submitted with the grading plan. All new slopes shall be a I2:1 (horizontal to vertical). A final compaction report shall be submitted and approved prior to issuance of building permits. A certification of line and grade, prepared by the project civil engineer, shall be submitted prior t ~ building permits. E , including but not limited to desiltation basins, shall be installed and J from Oct. 15th to April 15th. An erosion control plan shall be prepared by the project civil engineer and shall be submitted as part of the grading plan. The developer shall make provisions to insure the proper maintenance of all erosion control devices throughout their intended life. Applicant shall execul t of improvement for private road known as Mina De Oro Road for parcel 1 prior to Parcel Map approval. Said covenant shall be subject to approval by the City Attorney. Each parcel shall be provided with its own water well service line and Sewage System. Leach field layout or seepage pit layout for the residence sewage disposal system shall be submitted to the City's Engineering Services Department 1' :1 approval by the City Engineer prior to obtaining a septic sy, ' lation permit from the County of San Diego Department of Health. If a septic sy ' lation permit had been obtained without a City approval layout, one shall be submitted prior to installation of leach lines. GENER,~ 14. A right-of-way permit shall be obtained from the City's Engineering Services Department for any work to be done within the public street right-of-way or any City- held easement. Said work shall include, but is not limited to, construction of driveway approach, sewer lateral installation, water service line installation, and street 15. The parcel map shall conform to City standards and procedures, City subdivision ordinance, Subdivision Map Act, and Land Surveyors Act. 16. A processing fee, in addition to map checking fee, shall be paid to the City for all :i/or right-of-way dedications made through a separate :(s) other than a map. 18. A lation bond in an amount acceptable to the City Engineer shall be posted prior to pamel map approval. 19. Pamel Map shall include Health Department Certificate for septic system. 20. If a security bond is posted, payment of the fees shall be made prior t i a Certificate of Occupancy. Once payment is received in full said security bond could be released to the applicant. Payment is due prior to filing the final map. The access driveway for Parcel 2 shall be reviewed and approved by Caltrans, if necessary, along with the City of Poway Engineering Services Department - Traffic Division. COMPLIANCE WITH THE FOLLOWING CONDITIONS IS REQUIRED. COMPLIANCE SHALL BE APPROVED BY THE DEPARTMENT OF SAFETY SERVICES. Conditions for access, water, and construction design shall be determined when each parcel is submitted for improvement/development. However, Mina de Oro Road shall be widened to at least 20' (paved surface) from Poway Road to Parcel 1. COMPLIANCE WITH THE FOLLOWING CONDITIONS IS REQUIRED. COMPLIANCE SHALL BE APPROVED BY THE DEPARTMENT OF PUBLIC SERVICES. The parcel is located within the General PI 3tual trail scheme as a Community Trail having a fifteen foot wide dedicated easement that will be improved to City Standards (signs, brow ditches, erosion control bars, etc.). Fencing is required and a decomposed granite surface (4 inches at 95 percent compaction) as needed shall be placed. Also, the equestrian staging area needs to be improved.
