P- 99-32 A OF THE CITY OF THE CITY OF POWAY, CALIFORNIA APPROVING HILLSIDE/RIDGELINE MINOR DEVELOPMENT REVIEW 99-25 ASSESSOR'S PARCEL NUMBER 321-270-60 WHEREAS, Hillside/Ridgeline Minor Development Review 99-25, submitted by Mary Anne Altaffer, Applicant, Gordon and Karen Erickson, Owners, requests approval to construct a 3,100 square foot, two-story home on the vacant property located at 15651 Blue Crystal Trail within the Rural ResidentiaI-A zone. WHEREAS, pursuant to G I Code Section 66020(d)(1), NOTICE IS FURTHER GIVEN that the 90-day period to protest the imposition of any fee, dedication, reservation, or otb described in this resolution begins on the effective date of this resolution and any such protest must I~ that complies with Section 66020. WHEREAS, on April 27, 1999, the City Council held a hearing to solicit from the public, both pro and con, relative to this application. NOW, THEREFORE, the City Council does hereby follows: The project is found to be Categorically Exempt Class 3, under the provisions of the California E Quality Act in that it is the development of a residence and an accessory structure. The City finds that in accordance with the Poway Habitat Conservation Plan the required findings for approval of the mitigation for the removal of natural habitat are as follows: A= The mitigation is consistent with and furthers the implementing objectives of the Poway Habitat Conservation Plan in that the developer is required to mitigate removed habitat at a 2:1 ratio through on-site or off-site dedication of undisturbed and unencumbered habitat, and/or payment of a mitigation in-lieu fee at th ' 31ished at grading or clearing permit issuance. The mitigation habitat shall be located in the Mitigation Area to enhance the long-term viability and function of the preserve system. The mitigation will be to the long-term benefit of the covered species and their habitats in that the payment of a mitigation cash in-lieu fee or the dedication of t over undisturbed Resolution No. P- 99-32 Page 2 Do coastal sage habitat will promote a meaningful addition to the assembly of a viable regional system of :t natural habitat habitat linkages, buffers and wildlife corridors. The mitigation shall foster the implementation of the Poway Habitat C PI ~ective and efficient manner in that any proposed ~ :ion area is required to be within an identified mitig i' :hin the City or the payment of a mitigation in-lieu fee which will go towards the pumhase of like habitat within an identified mitigar Ihin the City. The mitigation will not result in a negative fiscal impact with regard to the implementation of the Poway Habitat Conservation Plan. The approved project is consistent with the general plan in that it proposes the construction of a single family residence on property that is designated for residential use. That the approved development will not have an aC :hetic, health, safety or architecturally related impact upon adjoining properties, in that the residence is compatible with existing homes in the area and the grading has been designed to appear natural and ' ' 31e impacts. That the approved development is in compliance with the Zoning and Grading Ordinance, in that it complies with the property development standards of the RR-A zone. That the approved development encourages the ordedy and h appearance of and property within the City, in that the surrounding properties consist of large rural residential lots with widely spaced hillside ~cil Decision: The City Council hereby approves Minor Development Review 99-25 subject to the following conditions: Resolution No. P- 99 - 32 Page 3 Within 30 days of approval (1) the applicant shall submit in writing that all conditions of approval have been read and understood. COMPLIANCE WITH THE FOLLOWING CONDITIONS IS REQUIRED. COMPLIANCE SHALL BE APPROVED BY THE DEPARTMENT OF DEVELOPMENT SERVICES. SITE DEVELOPMENT Site shall be developed in accordance with the approved building and grading plans on file in the Department of Development Services and the conditions contained herein. Revised site plans and building )orating all conditions of approval shall be submitted to the Development Services Department prior to ' grading and building permits. Approval of this request shall not 31iance with the Zoning Ord' :1 all other applicable City Ordinances in effect at the time of grading and building permit issuance. The applicant shall comply with the latest adopted Uniform Building Code, Uniform Mechanical Code, Uniform Plumbing Code, National Electric Code, Uniform Fire Code, and all other applicable codes and ord' ~'ect at the time of building permit issuance. The applicant shall pay school fees at the rate established at the time of building permit issuance. Presently the school fee rate is $1.93 per square foot of assessable space (living area). Please be aware that the Poway Unified School District is currently considering increasing the school fee rate. The developer shall pay an Affordable Housing In-Lieu Fee in the amount of $4500 to the Development Services Department prior to building permit issuance. In accordance with Poway General Plan Hillside Development strategies, the : of grading on the site shall not exceed 1.67 acres. If revegetation is implemented per revegetation and monitoring :lations of a biologist, the leach field area(s) shall not count toward the amount of grading. The project will impact approximately 1.8 acres of chaparral habitat through grading and fire break Th Iowable project habitat impact cannot exceed 2 acres. The required mitigation or replacement ratio for project impacted habitat is 2:1. A biological conservation easement shall be recorded over the southerly portion of the property containing the coastal sage habitat in accordance with the biological file with the Development Services Department and the Poway Subarea Habitat Conservation Program. The biological conservation easement dedication shall be accomplished prior to grading permit issuance. In accordance with the City of Poway Landscape Guidelines, the applicant shall submit a brush management plan 1' d approval by the Safety Services and Development Services Departments. This shall be accomplished prior to grading permit issuance. The property owners shall submit written, signed d questing that the property be annexed into the Poway Habitat Plan Mitigation Area. The applicant shall provide evidence of legal parcel to the Development Services Department prior to issuance of grading permit. In the event acceptable documentation is not available, the applicant shall apply for a Certificate of Compliance with the Development Services Department prior to grading permit issuance. Recordation ofthe Certificate of Compliance shall be accomplished prior to approval of final occupancy for the residence. The exterior of the required Fire Department water tank shall be an earthtone color to blend with the surrounding natural vegetation. Its completion thereof shall be done prior to f Building's Certificate of Occupancy. A private road ri ;]reement, for Blue Crystal Trail, in a form satisfactory to the City Attorney, shall be executed by the owner and/or developer prior to building permit issuance. Said agreement is to comply with Ordinance No. 280, City Code Section 12,20.060. Leach field layout or seepage pit layout for the resid ~]e disposal system shall be submitted to the City's Development Services Department 1' :1 approval by the City Engineer prior to obtaining a septic system installation permit from the County of San Diego Department of Health. If a septic sy : lation permit had been obtained without a City approved layout, one shall be submitted prior to installation of leach lines.
