A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
UPHOLDING STAFF APPROVAL OF MINOR DEVELOPMENT REVIEW 98-115
ASSESSOR'S PARCEL NUMBER 273-900-27
WHEREAS, Minor Development Review 98-115, submitted by Jack Kirker, Applicant
requested approval to construct a 4,021 square foot, single story, 32-foot-tall home in
Lomas Verdes Estates on a one acre lot located at 17750 Valle Verde Road, within the
RR-C zone; and
WHEREAS, on February 2, 1999, the Planning staff of the City of Poway approved
said application with conditions; and
WHEREAS, a neighboring property owner filed an appeal of the staff decision to the
City Council citing neighborhood incompatibility of the proposed design and ob :
views.
WHEREAS, on April 27, 1999, the City Council held a hearing to solicit
from the public, both pro and con, relative to this application.
NOW, THEREFORE, the City Council does hereby
follows:
This action is not subject to th
review process.
The approved project is consistent with the general plan in that it proposes the
construction of a single family residence on property that is designated for
residential use.
That the approved project will not have an adverse aesthetic, health, safety or
architecturally related impact upon adjoining properties, in that the residence is
compatible with existing homes in the area.
That the approved project is in compliance with the Zoning and Grading Ordinance,
in that it complies with the property development standards of the RR-C zone.
That the approved project encourages the orderly and h

large rural residential lots with widely spaced homesites.

S ouncil Decision:
The City Council hereby upholds staff approval of Minor Development Review 98-115. All
odginal conditions of approval remain in force. An additional condition is hereby adopted
requiring that the applicant, if he has not already done so, instruct his Engineer of Work to
erect story poles on the property and certify the height and location of the poles for their
accuracy, in writing. Applicant shall notify the appellants and City staff, when the story
poles are certified, allowing three days for their inspection and shall supply them with a
copy of the written certification from the Engineer of Work. This shall be accomplished pdor
to building permit issuance.
APPROVED and ADOPTED by the City Council of the City of Poway, State of
