Res P-99-48 RESOLUTION NO. P-99-48 a RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, APPROVING TEMPORARY USE PERMIT 99-28 WHEREAS, Temporary Use Permit 99-28, submitted by the City of Poway, applicant, requests approval of the Old Poway Park event to be held on July 4th, 1999; and WHEREAS, pursuant to G : Code Section 66020(d)(1), NOTICE IS FURTHER GIVEN that the 90-day period to protest the imposition of any fee, dedication, or other exaction described in this resolution begins on the effective date of this resolution and any such protest must be in a manner that complies with Section 66020. NOW, THEREFORE, the City Council does hereby follows: Pursuant to the procedures of the City of Poway, implementing the California E Iai Quality Act, the al- :1 project is categorically exempt, Class 4e and 1 lc, in that the Old Poway Park celeb lis temporary in nature and will have negligible or no permanent effect on th l. That the proposed use is ~n accordance with the purpose and standards of Section 17.26.020 of the Poway Municipal Code. il Decision: The City Council hereby approves Temporary Use Permit 99-28 subject to the following conditions: COMPLIANCE WITH THE FOLLOWING CONDITIONS IS REQUIRED. COMPLIANCE SHALL BE APPROVED BY THE DEPARTMENT OF DEVELOPMENT SERVICES, PLANNING DIVISION. All food and ddnk ~all operate under the auspices of the Lions Club and their County Health Department permit. Volunteer cooks shall abide by Health Department standards for food and drink Site shall be used in accordance with the site and parking plan submitted by the Community Services Department. Community Services Department personnel shall be responsible for coordination of the event with other City departments, the Sheriff's Department, and volunteers. Resolution No. P-99-48 Page 2 4. The approval shall become null and void on July 5, 1999 at which time the site shall be restored to its original condition. 5. Portabl :luired at the ratio of I to every 50 people up to 500 people. Provisions for any temporary electrical power will require an electrical permit and an inspection approval by the Building Safety Inspection Division. 7. Event signs will be placed on Community Events kiosks. Two signs about the event may be placed along Midland Road near Old Poway Park. 8. The County Sheriff's Department shall be contacted one-half hour prior to the ~of the simulated shooting activity. Non-emergency phone number: 513- 2800. 9. Neighbors will be notified by Old Poway Park staff prior to the event. 10. A copy of this permit shall be provided to the "Apache Canyon Gang" staging the train robbery. Bullet caps (with primer only) are to be used. COMPLIANCE WITH THE FOLLOWING CONDITIONS IS REQUIRED. COMPLIANCE SHALL BE APPROVED BY THE DEPARTMENT OF PUBLIC SERVICES. 11. The Public Services Department will provide any needed barricades and signs for traffic control at or near Old Poway Park. COMPLIANCE WITH THE FOLLOWING CONDITIONS IS REQUIRED, COMPLIANCE SHALL BE APPROVED BY THE DEPARTMENT OF SAFETY SERVICES, 12. Any barricades used are to have attendants at all times. 13. Midland Road is t 31e to emergency vehicle traffic. 14. All booths, canopies and tents ara to be tagged with State Fire Marshal approval. 15. All booths or tents having electrical power, using any kind of flammable fuel, or doing any cooking will have a fire extinguisher rated not less than 2A10BC. 16. The storage and removal of all trash material shall be provided so as not to constitute a fire hazard. Resolution No. P- 99-48 Page 3 17. All for decorative purposes shall be non-flammable. 18. All electrical cords and 3all be utilized only in an approved manner. COMPLIANCE WITH THE FOLLOWING CONDITIONS IS REQUIRED. COMPLIANCE SHALL BE APPROVED BY THE SHERIFF'S DEPARTMENT. 19.
