P- 99-50 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA APPROVING HILLSIDE/RIDGELINE MINOR DEVELOPMENT REVIEW 99-52 ASSESSOR'S PARCEL NUMBER 314-650-0'i WHEREAS, Hillside/Ridgeline Minor Development Review 99-52, submitted by Dave and Laurie Churchill, applicants, requests approval to constn.~ct a 6,772 square foot home on a 5.0 acre parcel located at the northern extension of Midland Road on the south flank of Twin Peaks Mountain; and WHEREAS, pursuant to G I Code Section 66020(d)(1), NOTICE IS FURTHER GIVEN that the 90-day period to protest the imposition of any fee, dedication, reservation, or otb described in this resolution begins on the effective date of this resolution and any such protest must I~ that complies with Section 66020; and WHEREAS, on July 6, 1999, the City Council held a hearing to solicit comments from the public, both pro and con, relative to this application. NOW, THEREFORE, the City Council does hereby follows: Secti~ Iai F The project is found to be Categorically Exempt Class 3, under the provisions of the California E Quality Act in that it is the development of a residence and an accessory structure. ~nmenl Conditions reflecting mitigation req ';]nified by use of an asterisk (*). The City finds that in accordance with the Poway Habitat Conservation Plan the required findings for approval of the mitigation for the removal of natural habitat are as follows: A= The mitig' ' : with and furthers the implementing objectives of the Poway Habitat Conservation Plan in that the developer is required to mitigate removed habitat at a 1:1 ratio chaparral and 2:1 for coastal sage habitat, through on-site or off-site dedication of undisturbed and unencumbered habitat, and/or payment of a mitigation in-lieu fee at the rate established at grading or clearing permit issuance. Bo The mitigation habitat shall be located in the Mitigation Area to enhance the long-term viability and function of the preserve system. _ Resolution No. P-99- 50 Page 2 The mitigation will be to the long-term benefit of the covered species and their habitats in that the payment of a mitigation cash in-lieu fee or the dedication of a conservation easement over undisturbed chaparral and/or coastal sage habitat will promote a meaningful addition to the assembly of a viable regional system of' :t natural habitat habitat linkages, buffers and wildlife corridors. The mitigation shall foster the ' implementation of the Poway Habitat C Plan in an effective and efficient that any proposed on-site or off-site conservation area is required to be within an identified mitig :hin the City or the payment of a mitig fee which will go towards the purchase of like habitat within an identified mitigat' :hin the City. The mitigation will not result in a negative fiscal impact with regard to the I implementation of the Poway Habitat Conservation Plan. That the approved development encourages the orderly and h appearance of and property within the City, in that the surrounding properties consist of large rural residential lots with widely spaced hillside ,-- Resolution No. P- 99- 50 Page 3 ~ion: The City Council hereby approves Minor Development Review 99-52 subject to the following conditions: n 30 da' COMPLIANCE WITH THE FOLLOWING CONDITIONS IS REQUIRED. COMPLIANCE SHALL BE APPROVED BY THE DEPARTMENT OF DEVELOPMENT SERVICES. A) Compliance with the following conditions is required prior I F the grading permit: Revised site plans and building elevations incorporating all conditions of approval shall be submitted to the Development Services Department prior to ' ! grading and building permits. Muted earth 1 ~all be used for exterior walls and roofing materials. In accordance with Poway General Plan Hillside Development strategies, the amount of grading on the site shall not exceed 0.5 acres. If revegetation is implemented per the revegetation and monitoring :lations of a biologist, the leach field area(s) shall not count toward the amount of grading. In accordance with the City of Poway Landscape Guidelines, the applicant shall submit a brush management plan t' :1 approval by the Safety S :1 Development Services Departments. The project will impact an additional 0.5 acres of coastal sage - chaparral scrub habitat through grading and fire break The required mitigation or replacement ratio for the project impacted habitat is 2:1 for coastal sage and 1:1 for chaparral. A biological : shall be recorded over the portion of the property containing coastal sage scrub in accordance with the biological file with the Development Services Department. The biological : dedication shall be accomplished prior to grading permit issuance. The exterior of any required Fire Department water tank shall be an earthtone color to blend with the surrounding natural vegetation. 6. B) C) Resolution No. P- 99- 50 Page 4 the property shall be submitted to the City's Development Services Department, Engineering Division, for review and approval. The grading plan shall show the access to the property together with th ; the proposed driveway, and the retaining walls. The retaining walls shall comply with the San Diego Regional Standard Drawings, or structural calculations shall be submitted for any non-standard wall. The driveway shall comply with the specifications provided in Section 17.08.170D of the Poway Municipal Code. The grading plan must show th ' ' ,-'tural section of the driveway. There shall be a minimum five (5)-foot setback from the toe/top of the slopes to the new house and the associated improvements. The grading plan shall include an erosion control plan prepared by the engineer of work. The plans shall be drawn to a scale of 1"=20' on a standard sheet of mylar. A :igation report shall be submitted with the grading plan. All applicable engineering, permit, and inspection fees shall be paid. Grading securities in the form of a performance bond and a cash deposit shall be posted. A drainage study using the 100-year storm frequency criteria shall be submitted with the grading plan. Surface runoff' i throe (3) cubic feet per second shall be undergrounded, in lieu of draining over the driveway, or the slopes. Compliance with the following is required during the construction: 11. Grading of the property shall be performed in accordance with the Uniform Building Code, the Poway Grading Ordinance, the approved grading plan, the soils report, and accepted grading practices. 12. Payment of the Affordable Housing In-Lieu Fee in the amount of $4,500. 15. Proof of payment of school fees to the Poway Unified School District. 16. Rough grading of the site must be completed and shall meet the City Inspector's approval. 17. A certification of line and grade prepared by the Civil Engineer of work shall be submitted. 18. A final compaction report shall be submitted and approved. 19. The following development fees shall be paid. These fees are currently in effect and are subject to change without notice: 20. Traffic Mitigation: $ 990.00 Park: $2,720.00 Drainage: $1,570.00 A leach field layout or a seepage pit layout for the residence sewage disposal system shall be submitted to the Engineering Division for review and approval. A septic permit from the San Diego County Health Department is required. If a septic sy, lation permit was obtained without a City approved layout, one shall be submitted prior to installation of the leach lines. A well system for the residence shall be approved by the San Diego County Department of Health. 27. Should there be a need for a new fire hydrant, a water system analysis shall be prepared to establish the proper size and location of the public water system. The applicant shall pay to the City the cost of preparing the analysis prior to submittal. Improvement plans shall be submitted for approval by the Engineering Division. Additional plan check and inspection costs shall be paid by the developer. 28. A drainage system capable of handling and disposing all surface water within the project and flowing onto the property from adjacent lands is required. The system shall be shown on the grading plan. 29. Prior to the release of the grading security, record drawings shall be submitted to the Engineering Division and shall be approved by the project engineer and the inspector. 30. Future grading of this hillside lot shall be prohibited. 31. This approval shall b II and void if building permits are not issued for this project within two years from the date of project approval. COMPLIANCE WITH THE FOLLOWING CONDITIONS IS REQUIRED. COMPLIANCE SHALL BE APPROVED BY THE DEPARTMENT OF SAFETY SERVICES. 32. Roof covering shall meet Class A fire-retardant testing as specified in the Uniform Building Standards No. 32-7 for fire retardant roof covering materials, per City of Poway Ordinance #64. 33. Approved numbers or addresses shall be placed on the building in such a position as to be plainly visible and legible from the street fronting the property. The access roadway shall be extended to within 150' of all portions of the exterior walls of the first story of any building. Where the access roadway cannot be provided, approved fire protection system(s) shall be provided as required and approved by the Fire Marshal. 38. This dwelling is being built on a parcel size of 5 acres and is beyond the distance from the nearest fire hydrant. The dwelling will have to have standby water for firefighting and a residential sprinkler system. Contact the Fire Prevention Bureau for details. 39. A residential fire sprinkler system with a one-inch meter will be required. Plans shall be submitted to the Fire Prevention Bureau for approval prior to installation. (If a one-inch lateral off the street main is currently not present, one will have to be installed). 40. Provide a 10,000 gallon water tank equipped with a 4" underground line to a 2 W' National Standard Thread discharge installed within 50 feet of the residence.
