A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
APPROVING TENTATIVE PARCEL MAP 96-01TE
ASSESSOR'S PARCEL NUMBER 278-240-15
WHEREAS, a one-year time extension for Tentative Parcel Map 96-01TE,
hereinafter "Map" submitted by Jerry and Linda Strauss, applicants, for the purpose of
subdividing a 7.66 acre property located at 15466 Eastvale Road into three parcels. The
zoning of the property is Rural Residential B - High Valley.
WHEREAS, on July 20, 1999, the City Council held a hearing on the above-
referenced item.
WHEREAS, pursuant to G : Code Section 66020 (d)(1), NOTICE IS
FURTHER GIVEN that the 90-day period to protest the imposition of any fee, dedication,
reservation, or otb described in this resolution begins on the effective date of
this resolution and any such protest must I; that complies with Section 66020.
NOW, THEREFORE, the City Council does hereby

The approved project is consistent with the General Plan in that the 2.00,
2.48 and 2.08 (net) acre p l with the RR- B zoning and
the General Plan designation of Rural Residential B.
The design and imp required of the tentative parcel map are
consistent with all applicable general and specific plans; in that the approved
parcel sizes and config Jhere to the development standards for the
RR-B zone.
The site is physically suitable for the type of development and the density
proposed; in that the site is large enough to provide three parcels, each 2
acres or g :t with a proposed pad area of liguous
square footage of less than 25 percent slope for the construction of new
homes.

The design of the subd' ' ' : likely I ~)stantial
damage and avoidable injury to h ~1 wildlife or other habitat in that
the site has been used for avocado growing and does not contain native
vegetation. The stream area along the south side of the property will be
retained in its natural state.
The tentative parcel map is not likely 1 public health problems
in that City water service is available to the property and the County
E Iai Health Division has found the p ' 31e for septic
systems.
The design of the tentative parcel map will not conflict with any easement by
the public at large, now of record, t' through or use of the property
within the proposed subdivision.

The City Council hereby approves Tentative Parcel Map 96-01TE subject to the
following conditions:
Within 30 days of approval the applicant shall submit in writing that all
conditions of approval have been read and understood.
Approval of TPM 96-01TE is based on il
contained in City Council Resolution P- 96-37.

The applicants shall participate in a future l district for the
upgrading of the water system in the High Valley area with a second
reservoir.
4. The tentative map approval shall expire on May 21, 2000.
