A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
AMENDMENT TO APPROVED TTM 89-05
ASSESSOR'S PARCEL NUMBERS 321-200-44 & 47
WHEREAS, a request 1' :lment to approved Tentative Tract Map 89-05,
hereinafter "Map" submitted by FAMSTE I I Company, Inc., owners of Poway
Summit Estates, for the purpose of modifying specified conditions of approval in
subdividing real property situated at the northwest comer of Poway Road and Espola Road
into 13 single-family lots, came before the City Council for public hearing and action on July
20, 1999; and
WHEREAS, the Director of Development Services h :led approval of
the specified changes to the Map subject to all conditions set forth in the Development
Services Department report; and
WHEREAS, pursuant to G I Code Section 66020(d)(1), NOTICE IS
FURTHER GIVEN that the 90-day pedod to protest the imposition of any fee, dedication,
reservation, or otb described in this resolution begins on th date of
this resolution and any such protest must b that complies with Section 66020.
NOW, THEREFORE, the City Council does hereby
follows:
A Negative Declaration with Mitigation Measures was originally issued for the
project on April 30, 1991 which adequately addresses the potential Iai

proposed in that the site is a relatively fiat knoll and can :late the

the area of the property designated for home construction has been
previously disturbed. Permits for the grading of the site will be issued only
after the project proponent has mitigated impacts to coastal sage scrub
habitat in accordance with the Poway Subarea Habitat Conservation Plan.
The approved tentative tract map is not likely t public health
problems in that City water and sewer systems will be provided to the new
parcels. Low-flow plumbing fixtures will be required throughout future
buildings on the site. Landscaping plans will be prepared providing for
minimal water consumption and incorporating I irrigation
techniques for trees and shrubs as well as fire prevention techniques.
The design of the tentative tract map will not conflict with any easement by
the public at large, now of record, 1' through or use of the property
within the proposed subdivision.
The City Council hereby amends the formerly approved Tentative Tract Map 89-05
subject to the following conditions:
Within 30 days of approval the applicant shall submit in writing that all
conditions of approval have been read and understood.
Approval of the amendment to 'I-I'M 89-05 is based on il :h
the conditions contained in City Council Resolutions P-93-20, P-91-
27(except as modified herein), and the mitigation requirements contained
within the Poway Subarea Habitat Conservation Plan and appropriate
mitigation for the loss of Quino Checkerspot Butterfly habitat as required by
the U.S. Fish and Wildlife Service should the species be found within the
development area of the property.
Homes and any accessory :1 on Lot 1 and Lots 7
through 13 shall be permitted to be no taller than 22 feet in height, although
if the building pad ' lowered, the building height may t, J
one foot for each foot the pad is lowered, up 1 ' 35 feet.

Grading on Lots 1 and 5 shall be limited to the larger of 50% of the lot area
or 35,000 square feet of total disturbance, including driveway and slopes.
All other building lots shall be permitted to be graded in their entirety.
The building pad heights for Lots 4 and 5 are permitted to be placed at the
new proposed elevations.
Tennis court pads shall be permitted on Lots 2, 3, 6, 7, 8, 9, 10, 12, and 13
provided that no cut orfill slopes shall be created which exceed eight feet in
height. Fencing for the courts shall be dark, non-reflective No

A landscape plan shall be produced and submitted to the City of Poway
Development Services Department which specifies the planting and irrigation
