P-99-57 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA APPROVING DEVELOPMENT REVIEW 99-09 ASSESSOR'S PARCEL NUMBER 314-194-49, 52 WHEREAS, Development Review 99-09 submitted by TopMark C Applicant, requests approval of the home designs and model complex for 26 tract homes for Tentative Tract Map 98-06, located at the southwest comer of Midland Road and Twin Peaks Road in the RS-4 zone; and WHEREAS, pursuant to G l Code Section 66020(d)(1), NOTICE IS FURTHER GIVEN that the 90-day period to protest the imposition of any fee, dedication, reservation, or otb described in this resolution begins on the effective date of this resolution and any such protest must b that complies with Section 66020; and WHEREAS, on August 3, 1999, the City Council held a hearing to solicit from the public, both pro and con, relative to this application. NOW, THEREFORE, the City Council does hereby follows: The City hereby certifies that the previously issued Negative Declaration for Tentative Tract Map 98-06 adequately addresses the potential Iai impacts of the proposed development. S6 The approved project is consistent with the Poway General Plan in that it proposes the of new homes on a property which is zoned for that use and where a tentative tract map for that purpose was recently approved. The approved project will not have an aC :hetic, health, safety, or architecturally related impact upon adjoining properties because the site and the buildings have been designed with reference to the surrounding homes and in particular in concert with the Old Poway Specific Plan in terms of materials, scale, and other architectural features. The approved project encourages the orderly and h of structures and property within the City through its Zoning Ordinance which provides high standards for throughout th :y. 3pearance ! with the development Resolution No. P- 99-57 Page 2 The City Council hereby approves Development Review 99-09 subject to the following conditions: Within 30 days of approval the applicant shall submit in writing that all conditions of approval have been read and understood. Prior The grading and improvement plans which are currently under review for the subdivision shall be approved by the Engineering and Planning Divisions of the Development Services Department. Grading the form of a performance bond and cash deposit, or a letter of credit shall be posted. Th' be done prior to the Final Map approval. All permits from outside regulatory agencies, including the U.S. Army Corps of Engineers, California Department of Fish and Game and Regional Water Quality Control Board shall be submitted to the Planning Division of the Development Services Department. o Th < trees which are being preserved on the property shall be fenced at the direction of a qualified arborist. The applicant shall comply with the latest adopted Uniform Building Code, Uniform Mechanical Code, Uniform Plumbing Code, National Electric Code, Uniform Fire Code, and all other applicable codes and ord' ~'ect at the time of building permit issuance. Plans for each model home shall be submitted to and approved by the Department of Safety Services. Verification of the payment of school fees shall be presented to the Planning/Building Divisions. The sales office is required to have a sign over the front door stating "This Door to Remain Unlocked During Business Hours." This approval shall expire at the end of two years from the date of the approval if building permits have not been obtained within that time.
