P- 99-58 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA APPROVING HILLSIDE/RIDGELINE MINOR DEVELOPMENT REVIEW 99-57 ASSESSOR'S PARCEL NUMBER 321-180-67 WHEREAS, Hillside/Ridgeline Minor Development Review 99-57, submitted by Robert and Susan Gdmes, Applicants, request approval to construct a 3,678 square foot home on a vacant 4 acre parcel located on the north side of Addan Street within the 13800-13900 block. The property has a split zoning designation of Rural Residential A and Rural Residential C; and WHEREAS, pursuant to G l Code Section 66020(d)(1), NOTICE IS FURTHER GIVEN that the 90-day period to protest the imposition of any fee, dedication, reservation, or otb described in this resolution begins on the effective date of this resolution and any such protest must I: that complies with Section 66020; and WHEREAS, on August 17, 1999, the City Council held a hearing to solicit from the public, both pro and con, relative to this application. NOW, THEREFORE, the City Council does hereby follows: S: The project is found to be Categorically Exempt, Class 3, under the provisions of the California E Quality Act in that it is the development of a residence. The City finds that in accordance with the Poway Habitat Conservation Plan the required findings for approval of the mitigation for the removal of natural habitat are as follows: The mitig I with and furthers the implementing objectives of the Poway Habitat C Plan in that the developer is required to mitigate removed habitat at a 2:1 ratio through off-site dedication of undisturbed and unencumbered habitat and/or payment of a mitigation in- lieu fee at th 31ished at grading or clearing permit issuance. Any proposed mitigation habitat shall be located in the mitigation area to enhance the long-term viability and function of the preserve system. The mitigation shall foster the incremental impl of the Poway Habitat C Plan in an effective and efficient that any proposed off-site conservation area is required to be within an identified miti~ ' :hin the City or the payment of a miti§ fee which will go towards the purchase of like habitat within an identified mitig within the City. The mitigation will not result in a negative fiscal impact with regard to the I implementation of the Poway Habitat Conservation Plan. COMPLIANCE WITH THE FOLLOWING CONDITIONS IS REQUIRED. COMPLIANCE SHALL BE APPROVED BY THE DEPARTMENT OF DEVELOPMENT SERVICES. The project will impact approximately one acm of coastal sage scrub and disturbed habitat through grading and fire break The required mitig 31acement ratio for the project impacts to habitat is 2:1. The applicant shall either provide for off-site dedication of a biological conservation easement of similar quality coastal sage scrub habitat or pay a mitigation cash in-lieu fee which is presently $10,000/acm. Grading or brush clearing for the project shall not occur during the period of February 15 through August 15 which is the nesting season for the California Gnatcatcher. A grading plan for the development of the property shall be submitted to the City's Development Services Department for review and approval prior to ; a grading permit and start of grading operation. If the operation than 50 cubic yards of grading or the cut is more than 2 feet and the fill is more than one foot, a grading permit is required, if the grading lwork t of less than 50 cubic yards, a grading permit is not required. If no grading is required, a certification from a State Registered Civil Engineer indicating the amount of earthwork -- Resolution No. P- 99-58 Page 4 B) involved shall be furnished to City's Development Services Department, and a $500 inspection fee shall be paid prior to building permit issuance. The grading plan shall show the driveway/access to the property with the slope grade and elevation of the proposed driveway. The driveway shall comply with the si: provided in Section 17.08.170D of the Poway Municipal Code. In addition, grading plan must also show the minimum structural section of the driveway. There shall b ' ' '* a five (5) foot setback from the toe/top of the slopes to the new house, and th :1 improvements. The grading plan shall include an erosion control plan prepared by the engineer of record. 7. Soils investigation report shall be submitted with the grading plan. o A drainage study using the 100-year storm frequency criteria shall be submitted with the grading plan. A drainage system capable of handling and disposing all surface water within the project and flowing onto the property shall be required. Concentrated flow over the driveway greater than three (3) cubic feet per second will not be acceptable. o All applicable engineering permits, plan check and inspection fees shall be paid. A leach field layout or a seepage pit layout for the residence sewage disposal system shall be submitted to the Engineering Division 1' :t approval. A septic system permit from the San Diego County Health Department is required. If a septic system installation permit was obtained without a City approved layout, one shall be submitted prior to installation of the leach lines. All proposed utilities within the project site shall be installed underground. 26. New utility 'facilities shall be per the req : the serving utility company and the Director of the Development Services. Miscellaneous Requirements: 28. Low volume plumbing fixtures and Iow water usage irrigation shall be installed within th '-Ience and its surrounding landscaping. 29. Should there be a need for a new fire hydrant, a water system analysis shall be prepared to establish the proper size and location of the public water system. The applicant shall pay to the City the cost of preparing the analysis prior to submittal. Improvement plans shall be submitted for approval by the Engineering Division. Additional plan check and inspection costs shall be paid by the developer. 30. A right-of-way permit shall be obtained from the Engineering Division for any work within the public right-of-way. The permit shall be obtained prior to start of work and all applicable permit fees shall be paid prior to permit issuance. 31. Future grading of this hillside lot shall be prohibited. 32. The height of any freestanding 1: I or any combination thereof shall not exceed six feet. -- Resolution No. p-99-58 Page 7 33. This approval shall become null and void if building I~ not issued for this project within two years from the date of project approval. COMPLIANCE WITH THE FOLLOWING CONDITIONS IS REQUIRED. COMPLIANCE SHALL BE APPROVED BY THE DEPARTMENT OF SAFETY SERVICES. 34. Roof covering shall meet Class A fire-retardant testing as specified in the Uniform Building Standards No. 32-7 for fire retardant roof covering per City of Poway Ordinance #64. 35. Approved numbers or addresses shall be placed on the building in such a position as to be plainly visible and legible from the street fronting the property. Said numbers shall contrast with their background. The address will be required at all private driveway entrances. 36. Dedicate and construct a 15' wide trail on the north side of Adrian Street prior to certificate of occupancy. 40. The subject property has access through a portion of Landscape M District (LMD) 83-1A. Under City policy and Proposition 218, the property is to be annexed into LMD 83-1A. Current Fiscal Year 99/00 $118.48 per pamel, but would not be collected until 00/01.
