P- 99-67 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA APPROVING CONDITIONAL USE PERMIT 99-09 ASSESSOR'S PARCEL NUMBER 317-281-11 WHEREAS, Conditional Use Permit 99-09 was submitted by Andy Parker for the purpose of establishing a Health Fitness Center within an existing building located at 13000 Danielson Street in the Light Industrial land use designation; and WHEREAS, on August 31, 1999, the City Council held a duly advertised public hearing to solicit from the public, both pro and con, relative to this application; and WHEREAS, pursuant to G l Code Section 66020(d)(1), NOTICE IS FURTHER GIVEN that the 90-day period to protest the imposition of any fee, dedication, reservation, or otb described in this resolution begins on the effective date of this resolution and any such protest must I: that complies with Section 66020. Resolution No. P- 99-67 Page 3 COMPLIANCE WITH THE FOLLOWING CONDITIONS IS REQUIRED. COMPLIANCE SHALL BE APPROVED BY THE DEPARTMENT OF DEVELOPMENT SERVICES, PLANNING DIVISION. DPMENT Site shall be developed in accordance with the approved site plans on file in the Development Services Department and the conditions contained herein. Prior to any use of the project site or 13 livity being :1 thereon, all conditions of approval contained herein shall be completed to the satisfaction of the Director of Development Services. Revised site plans, building elevations and floor plans, incorporating all conditions of approval shall be submitted to the Development Services Department prior to ~ building permits. An outdoor fenced area for a children's play area shall be shown as a future option. Approval of this request shall not ~liance with the South Poway Specific Plan, the Zoning Ordinance and all other applicable City ord ~'ect at the time of building permit issuance. The applicant shall comply with the latest adopted Uniform Building Code, Uniform Mechanical Code, Uniform Plumbing Code, National Electric Code, Uniform Fire Code, and all other applicable codes and ord ~'ect at the time of building permit issuance. Location shall be subject to approval by the Development Services Department prior to occupancy. The parking lot shall be slurry sealed and all parking spaces shall be double striped. The parking lot design shall comply with the A :h Disabilities Act, i.e., a 1:25 ratio 1' ~)le spaces with at least 31e space. 11. The aisle width for the parking area shall I: ' ' =25 feet. The 12 parking spaces on the east side of the building shall be compact spaces (8' x 15') and the corresponding spaces to the east of the parking aisle shall also be compact spaces. 12. A clear space between the bay doom at the east side of the building and wheel stop blocks for the proposed additional 12 parking spaces shall b ' ' =6.5 feet. 13. The parking shall be limited 1 : 104 spaces as permitted by the lease agreement: Seventy-four (74) and an additional proposed twelve (12) along the east side of the building, and an additional eighteen (18) ,1 spaces. COMPLIANCE SHALL BE APPROVED BY THE DEPARTMENT OF DEVELOPMENT SERVICES, ENGINEERING DIVISION. ~,ES 14. A sewer fee in the amount of $22,382.00 shall be paid to the Engineering Division of the Development Services Department prior to th ofthe occupancy and use permit for the proposed athletic health club. The fee was assessed based on the number of plumbing fixtures (38), Equivalent Dwelling Units (EDU's) of sewer capacity, and square footage of the health club. COMPLIANCE WITH THE FOLLOWING CONDITIONS IS REQUIRED. COMPLIANCE SHALL BE APPROVED BY THE DEPARTMENT OF SAFETY SERVICES. 15.
