P- 99-70 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA APPROVING TEMPORARY USE PERMIT 99-56 WHEREAS, Temporary Use Permit 99-56, submitted by the Greg Sundberg and The Chamber of C 3plicants, request approval of the Poway Days events to be held at various locations throughout the City extending from September 11 through September 26, 1999. WHEREAS, pursuant to G : Code Section 66020(d)(1), NOTICE IS FURTHER GIVEN that the 90-day period to protest the imposition of any fee, dedication, reservation, or otb described in this resolution begins on th date of this resolution and any such protest must I~ that complies with Section 66020. NOW, THEREFORE, the City Council does hereby follows: Pursuant to the procedures of the City of Poway, implementing the California E Iai Quality Act, the al: :1 project is categorically exempt, Class 4e, in that the Poway Days events are temporary in nature and have negligible or no permanent effects on th t. The City Council hereby approves Temporary Use Permit 99-56 subject to the following conditions: APPLICANT SHALL CONTACT THE COUNTY HEALTH DEPARTMENT REGARDING COMPLIANCE WITH THE FOLLOWING CONDITIONS: 1. All food and drink ~erated for profit shall secure th Department permit and State seller's permit. Provide a list of food if applicable, prior to each event. Inform all vendors using mobile units that their vehicles must comply with California Administrative Code, Title 17. Specifically, all doors must be self-closing, service windows must be 216 square inches or less, and shatterproof guards are required for all light bulbs. Vendors preparing food in temporary booths must provide floors, walls and ceilings for the entire stand. Food vendors shall provide a 2A10BC fire extinguisher at each cooking facility where open flames are present. APPLICANT SHALL CONTACT THE SHERIFF'S DEPARTMENT REGARDING COMPLIANCE WITH THE FOLLOWING CONDITIONS: o The applicants shall be on-site at all times when the parking areas are in use to assist with secudty of parked vehicles, to aid in th l of veh :1 out of the lots, to provi(~ 1 :1 t ' ' traffic congestion on surface streets. 10. All beverages shall be dispensed in paper cups -- no bottl lowed. 11. The applicants shall designate an on-site location for police, fire and paramedic units out of the main activity areas and maintain sufficient access for emergency vehicles at all times. 12. All music activities shall be terminated on or before 12:30 a.m. on the day following the event, and at no time shall the noise level exceed the permissible decibel (dB) level for th ;I designation. 13. The applicants shall have personnel designated at all times and at specified locations to provide liaison with representatives of the City's Fire and Sheriff's Departments. APPLICANT SHALL CONTACT THE DEPARTMENT OF DEVELOPMENT SERVICES, COMPLIANCE WITH THE FOLLOWING PLANNING DIVISION, REGARDING CONDITIONS: 20. 21. 22. 23. Any necessary building permits shall be secured. In all unpaved parking areas, temporary markers shall be provided to delineate parking areas and aisles and to ensure that no parking occurs within 100 feet of any existing residential structure. The applicants shall meet with rep of each of the City departments concerned at least one week prior to each event to ensure that all conditions of approval will be met. The sites shall be utilized in accordance with this resolution and the approved site plans on file in Development Services, Planning Division, except as may otherwise be provided herein, prior 1 : of the activity. Provision for temporary electrical power will require an electrical permit and an inspection approval by the Building Inspection Division. Provide a parking plan and map of shuttle services for Community Day, due by September 11,1999. 29. A site plan of the Rodeo Kick-Off Event shall be provided by the applicant along with signed authorization from property owner allowing the event, due by September 11, 1999. 30. Approval of this activity shall not 31lance with all otb I the Zoning Ord -I all other applicable City ordinances presently in effect. 31. The event sites shall be left free of debris, litter or any other evidence of the temporary use upon completion of the use. THE FOLLOWING CONDITIONS SHALL BE APPLICABLE TO THE POWAY DAYS PARADE TO BE HELD ON SEPTEMBER 18, 1999, BEGINNING AT POMERADO AND POWA¥ ROADS AND ENDING AT THE INTERSECTION OF POWAY AND BOWRON ROADS: 32. The westbound lanes of Poway Road shall be kept open for emergency vehicles. Street ' along the parade route will be kept clear of spectators for emergency traffic. 33. The Chamber of C barricades and sponsor of the parade, shall place all necessary the parade and detour routes. THE FOLLOWING CONDITIONS SHALL APPLY TO THE RODEO KICK OFF PARTY ON SEPTEMBER 23 AT THE ALBERTSONS PARKING LOT, THE POWAY DAYS RODEO ON SEPTEMBER 24, 25, & 26, AND DANCE TO BE HELD ON SEPTEMBER 25 AT THE POWAY VALLEY RIDERS ASSOCIATION ARENA: 34. One chemical restroom per 200 3ected shall be provided. 35. A temporary "NO PARKING - TOW-AWAY ZONE" shall be established on the west side of Tierra Bonita Road from Donart Ddve north to Poway Valley Road, to provide a wider ped king area into and out of the PYRA grounds, and to ensure sufficient access for emergency vehicles -- fire, paramedic and law I. "NO PARKING" signs shall be placed along this area approximately 250 feet on center. 36. The rodeo grounds shall be patrolled by uniformed private secudty guards (a ' ' :two I; ' ¥ guards) to assist with crowd control inside the rodeo area during hours of o1: :1 by members of rodeo and d ~tee to maintain security of equipment and control of personnel remaining/residing on property after hours of operation.
