A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
APPROVING DEVELOPMENT REVIEW 99-16
ASSESSOR'S PARCEL NUMBER 321-090-10,17
WHEREAS, Development Review 99-16 submitted by Barratt American, Applicant,
requests approval of the home designs for 12 homes for Tentative Tract Map 98-01,
located south of the east 1 ! Eastvale Road, in the RR-B zone; and
WHEREAS, pursuant to G l Code Section 66020(d)(1), NOTICE IS
FURTHER GIVEN that the 90-day period to pretest the imposition of any fee, dedication,
reservation, or otb described in this resolution begins on the effective date of
this resolution and any such protest must I; that complies with Section 66020;
and
WHEREAS, on October 5, 1999, the City Council held a headng to solicit
from the public, both pro and con, relative to this application.
NOW, THEREFORE, the City Council does hereby
follows:
The City hereby certifies that the previously issued Negative C for
Tentative Tract Map 98-01 adequately addressed th : new homes
on the subject property. No furth ~ :luired.
The approved project is consistent with the Poway General Plan in that it
proposed th ' ~ new I; property which is zoned for
that use and where a tentative tract map for that purpose was recently
approved.
The approved project will not have an ad :hetic, health, safety, or
architecturally related impact upon adjoining properties because the site and
the buildings have been designed with reference to the surrounding homes
and in pad 't with the development pattern in the High Valley
area in terms of scale, and other architectural features.
The approved project encourages the orderly and h 3pearance
of si :1 property within the City through its ! with the
Zoning Ordinance which provides high standards for development

The City Council hereby approves Development Review 99-16 subject to the
following conditions:
Within 30 days of approval the applicant shall submit in writing that all
conditions of approval have been read and understood.
A grading plan for the development of the lots shall be submitted to the City's
Development Services Department - Engineering Division 1' :1 approval.

Applicant shall prepare a Storm Water Pollution Prevention Plan (SWPPP) to
effectively address th ~ f into the storm drain system.
The SWPPP shall include, but not be limited to, an effective method of hillside
erosion and sediment control, a material storage site, to protect
material from being exposed to storm runoff, protection of all storm
drain inlets, on-site concrete truck wash and waste control, and otb of
Best Management Practice to effectively eliminate pollutants from entering the
storm drain system. Applicant shall certify the SWPPP prior to approval of the
grading and improvement plans. The SWPPP may be incorporated with the
erosion control plan, but shall be under separate cover from the grading and
improvement plans.
For development of five acres or more, applicant shall file with the State
Department of Water R 3plication of Notice of Intent under Statewide
General Construction Storm Water Permit (NOI), of which proof of acceptance shall
be submitted to the Development Services Department - Engineering Division prior
to issuance of a grading permit. Application form may be obtained from
Development Services upon request.

Project securities in the form of bonds, cash deposits, or letters of credit shall be

Engineers, California Department of Fish & Game, and Regional Water Quality

of Safety Services.
A 'life safety' residential fire sprinkler system with a one-inch meter will be required.
Plans shall be submitted to the Fire Prevention Bureau for approval prior to
installation. (If a one-inch lateral off the street main is currently not present, one
will have to be installed).

Prior to delivery of combustible building material on site, water and sewer systems
