P- 99- 75 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA APPROVING TENTATIVE TRACT MAP 99-03 ASSESSOR'S PARCEL NUMBER 278-170-04 AND 16 WHEREAS, E A l and Tentative Tract Map 99-03, hereinafter "Map" was submitted by Raymond Sims, applicant, requesting approval to subdivide the real property situated in the City of Poway, County of San Diego, State of California, described as a 15-acre property into 10 rural residential lots located on both the north and south sides of the 14000 block of Lake Poway Road, came before City Council for public hearing and action on October 26, 1999; and WHEREAS, pursuant to G l Code Section 66020(d)(1), NOTICE IS FURTHER GIVEN that the 90-day period to protest the imposition of any fee, dedication, reservation, or otb described in this resolution begins on the effective date of this resolution and any such protest must I: that complies with Section 66020; and WHEREAS, the Director of Development Services h :led approval of the map subject to all conditions set forth in the Development Services Department report; and WHEREAS, the City Council has read and considered said report and has considered other evidence presented at the public hearing. NOW, THEREFORE, the City Council does hereby follows: The City Council finds that the project will not have a significant adverse impact on the l and hereby issues a Negative Declaration with Mitigation Measures. Conditions reflecting mitigation requirements are signified by use of an asterisk (*). The approved project' : with the general plan in that the proposed lots are being created as rural residential building lots each greater than one acre in size. The site is physically suitable for the type of development proposed in that the property is gently sloping, is located within an area of residentially developed properties on all sides. Cable television services shall be provided and installed underground. The developer shall notify the cable companies (Cox C :1 Time-Warner Cable) when planning, designing, and constructing for utilities is to be accomplished. Rough grading of the lots is to be completed and meet the City Inspector's approval. A certification of line and grade for each lot, prepared by the engineer of work, shall be submitted to the City. Complete set of as-built record drawings for (site, water, grading, and roadways), signed by the engineer of work, shall be reviewed and approved by the City Engineering Division. Fire hydrants shall be installed at locations to be determined by the Fire Marshal. A water system analysis shall be required to establish the adequacy of the existing and any necessary <tension to serve the project, or to establish the proper size and location of the new public water system. The cost of the analysis shall be paid by the applicant / subdivider prior to submittal of improvement plans. Installation of fire hydrants shall be completed at a time designated by the Fire Marshal. Plan check and inspection costs shall be paid by the applicant. Prior to acceptance of property for sewer service, annexation to the sewer improvement area shall occur. 42. 43.
