Res P-99-77RESOLUTION NO. P- 99 - 77 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA MODIFYING RESOLUTION NO. P-90-34 FOR TENTATIVE TRACT MAP 89-13 REVISED (3) ASSESSOR PARCEL NUMBERS 277-170-09 & 13 WHEREAS, Tentative Tract Map 89-13 Revised (3), hereinafter "Map" submitted by Old Coach Realty, Inc., Bruce Tabb, applicant, for the purpose of modifying the conditions of TTM 89-13R, Old Coach Golf Estates, for 23.5 acres of the 708 acre Planned Community (PC) zone/specific plan site on the real property situated in the City of Poway, County of San Diego, State of California; and WHEREAS, the Director of Development Services h :led approval of the modification of the conditions for TTM 89-13R, Old Coach Golf Estates, for 23.5 acres of the 708 acre specific site plan for the map subject to all conditions set forth in the Development Services Department report; and WHEREAS, pursuant to G l Code Section 66020(d)(1), NOTICE IS FURTHER GIVEN that the 90-day period to protest the imposition of any fee, dedication, reservation, or otb described in this resolution begins on the effective date of this resolution and any such protest must I: that complies with Section 66020. WHEREAS, the City Council has read and considered said report and has considered other evidence presented at the public hearing. NOW, THEREFORE, the City Council does hereby follows: The City Council finds that the subject revision is Categorically Exempt (Class 5) as it is a minor alteration of land use limitations. The previously certified Final E Impact Report for Old Coach Golf Estates adequately addressed the potential Iai impacts for the overall project. Section 2: The approved project will b I with the general plan in that the proposed land use will be a development consisting of 5 single-family residences on lots of one acre or more in size and the General Plan designates this site for rural residential development. Tentative Tract Map 89-13R(3) is designed to :late the Iow density residential development. o = Resolution No. P- 99-77 Page 2 The design and imp : the revised tentative map I with all applicable general and specific plans in that conditions of approval for the map specify that it must comply with all req '~ I Specific Plan 89-01 which was written specifically for the Old Coach project. The site is physically suitable for the type of development approved in that the site is located with' ! predominantly single-family residential development and the underlying project has been designed to substantially observe the natural contours of the land and avoid impacts on sensitive riparian habitat and wildlife corridors. No physical imp proposed for the tentative map other than those approved with the original tentative map. The site is physically suitable for the density of the development approved; in that the proposed lots meet the acreage req of the specific plan and underlying RR-A, B and C zones. The design of the revised map is not likely to cause substantial damage and avoidable injury to humans and wildlife or their habitat because appropriate mitig have been identified by the project EIR and will be implemented with project The development of the tentative map is not likely to cause serious public health problems because City water and sewer services will be provided to the new parcels. Low flow plumbing fixtures will be required throughout future buildings on the site. Landscaping plans will eventually be prepared with minimal water consumption and incorporating Iow volume irrigation techniques for trees and shrubs. The design of the tentative map will not conflict with any easement acquired by the public at large, now of record, for access through or use of the property within the proposed subdivision. The project will not create adverse impacts on the l because it is a modification to a prior land division and the underlying Tract Map 89-13R will comply with all req :the project EIR. S 3: All existing conditions of approval of this p ~:ect except as modified below: Within 30 days of approval, the applicant shall submit in writing that all conditions of approval have been read and understood. Resolution No. P- 99-77 Page 3 The new Del Paso Drive is for a 36 foot wide paved road with curb and gutter on both sides with nine feet on each side for shoulders/general utility and access :hin a 54 foot easement (Local Urban Roads, Section 12.20.080 of the Poway Municipal Code). The applicant shall comply with all prior resolution conditions and mitigation for TTM 89-13R and TPM 92-04, and with Specific Plan 89-01, including biological mitigation and monitoring compliance, and a pro rata share for expansion of paramed .
